Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, Office of Acquisition Human Capital Management Services (AHCMS), 810 Vermont Ave. NW, Room 765, Washington, DC 20420. 2. Description of Action: The Office of Acquisition Human Capital Management Services proposes to negotiate a noncompetitive, sole source requirement with National Contract Management Association (NCMA), 21740 Beaumeade Circle, Suite 125, Ashburn, VA 20147. This requirement is to establish, maintain, and renew the annual organizational memberships with NCMA commencing September 4, 2018 and running through September 3, 2019. 3. Description of Supplies or Services: The purpose of this effort is for the Office of Acquisition Human Capital Management Services (AHCMS) to enter into a sole source contract with NCMA to establish, maintain, and renew organizational memberships. The AHCMS has a critical need to procure these memberships from NCMA. These memberships are in place to foster professional growth and educational advancement within the contracting profession. The estimated dollar value of this purchase is $166,750.00 for 1,450 nationwide memberships. 4. Statutory Authority: The statutory authority permitting other than full and open competition in this case is 41 U.S.C. 253(c) (1), as implemented by Federal Acquisition Regulation (FAR), Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." 5. Reason for Cited Authority: NCMA's primary function is to serve as a repository of knowledge by providing tools and resources to enable entry, development, and advancement for the contract management profession. This organization leads and represents the contracting profession. Their professional membership provides unparalleled access to industry and government wide conferences, networking opportunities, certifications, and informational webinars. 6. Efforts to Obtain Competition: Market research was conducted to determine if any firms currently exist capable of fulfilling similar membership services as NCMA under NAICS code 611430 - Professional and Management Development Training. VetBiz.gov was surveyed to identify a SDVOSB firms (under VA's statutory authority) capable of meeting the Government's known requirement at this time. However, none were found to be able to provide the level of membership services offered by NCMA. Additionally, current GSA schedules were examined to determine if any schedule holders offered comparable membership opportunities. Specifically, Schedule 874 - Mission Oriented Business Integrated Services (MOBIS) was deemed to be the most likely to offer organizational membership services geared toward the Federal contracting profession. However, none of the corresponding categories described services that could meet this requirement. Thus, market research indicated that NCMA is the only national organization of its kind, and as such provides public and private organizations an essential business management function that directly contributes to organizational success. The following are several of NCMA's unique services: Provide the structure, name recognition, and products directly and through chapters to contracting professionals worldwide Provide employers ready access to skilled human capital, learning resources, best practices, standards, and metrics of the profession. Enable other entities such as researchers, consultants, trainers, recruiters, advertisers and universities to gain broad access to defined segments of our community of practice. Principled professional conduct and achievement, as dictated by our Code of Ethics. An open exchange of ideas in a neutral forum. A culturally and professionally diverse membership. Excellence in everything we do, especially our service to our members and the contract management community. Continuing education, training and leadership opportunities through a network of local chapters. Remaining the preeminent source of professional development for contract Professionals. Recognizing and rewarding professional excellence and superior individual achievement in support of the contract management profession. Demonstrated professional achievement through certification. Quality volunteer leadership. Members' highly principled freedom of action and responsibility to the people and organizations they serve. 7. Determination of Fair and Reasonable Price: The Contracting Officer has made a determination that the price is fair and reasonable based on review of commercial list prices and the historical prices paid in the past for similar services. 8. Market Research: Market research has indicated that NCMA is the only source that provides public and private organizations this essential business management function on the scale required by a Department as vast and expansive as VA. 9. Other Considerations: This is the only source that satisfies and possesses the capabilities to provide these unique services to VA contracting organizations. 10. Listing of Sources Expressing Interest: A synopsis will be posted to the Federal Business in accordance with FAR 5.203(a). To date, there have been no other sources that have expressed interest in this requirement. 11. Statement of Actions to Remove or Overcome Barriers to Future Competition: In the future, market research will be conducted to determine if any additional vendors possess these capabilities that are uniquely offered by NCMA. 12. Requirements Certification: I certify the technical requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. 13. Approvals in accordance with FAR 6.304: Contracting Officer's Certification: I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
