Description

The Department of Veterans Affairs intends to solicit and negotiate a Sole Source, Firm-Fixed-Price Purchase Order with NuVasive, Inc. The procurement is two LessRay System and two 1YR maintenance plans for the Boise VA Medical Center. The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2), only one source. It was determined that the required items are only available from NuVasive, Inc., who is the sole manufacturer and sole distributor of the LessRay System. The North American Industry Classification (NAICS) code for this acquisition is 334510. This will be the only notice of the Government's intent to solicit, negotiate, and award to one source to satisfy this requirement. The Government plans to award a contract for this requirement on or around 09/05/2018. This notice satisfies the requirement at FAR 5.201(b)(1), to publicize the proposed contract action. This notice of intent is not a request for competitive proposals and no solicitation will be made available. Any responses received will only be considered for the purposes of determining the market place for future procurements. The Government will not pay for information submitted. This will be the only notice of the Government's intent to solicit, negotiate, and award to one source to satisfy this requirement.
