Justification and Approval for Other and Full and Open Competition TO: Adonis Mello, Deputy Director, Office of Executive Management FROM: Sean Hofmann, Deputy Director, Office of Executive Management DATE: August 20, 2018 SUBJECT: JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (J&A) FOR USAID/PAKISTAN'S PERFORMANCE MANAGEMENT ADVISOR U.S. PERSONAL SERVICES CONTRACT (PSC) POSITION 1. Issue This document sets forth the facts and rationale justifying the use of other than full and open competition for the Short Term, Offshore U.S. Performance Management Advisor Personal Services Contract (USPSC) position, in accordance with USAID's Acquisition Regulation (AIDAR) Subpart 706.3. 2. Nature and description of action to be approved This is a request to approve the selection of the USPSC Performance Management Advisor on an other than full and open competition basis. 3. Description of supplies or services required (including the estimated value) The Mission is seeking the services of a highly-experienced senior management advisor to provide expert advice and guidance to the Mission's senior leadership and USDH staff (including Senior Foreign Service personnel) on implementation of USAID's new Foreign Service Performance Management system and Senior Foreign Service performance management system as described in Automated Directives System (ADS) chapter 461 and other USAID polices and regulations. This includes providing career mentoring, training and coaching on the new system, guidance, policy updates, and consultations to raters and rated officers. The estimated cost of the contract is $58,623.00. 4. Identification of statutory authority permitting other than full and open competition The authority for this action is found in the Federal Acquisition Regulation (FAR) Subpart 6.3 and USAID's Acquisition Regulation (AIDAR) Subpart 706.302-70, which allows USAID to use other than full and open competition when it would impair or otherwise have an adverse effect on programs conducted for the purposes of foreign aid, relief, and rehabilitation. AIDAR 706.302-70(b)(1) allows this authority to be applied to personal services contractors serving abroad. 5. Demonstration that the nature of the acquisition requires the use of the authority cited USAID/Pakistan manages one of the largest and most complex United States Government (USG) assistance programs in the world. The Mission's high profile and politically sensitive portfolio, valued at approximately $4 billion, is implemented across six technical sectors (Energy, Economic Growth, Agriculture, Health, Education, and Governance) by nearly 300 positions, including over 50 U.S. Direct Hire (USDH) positions. The largest of the USG civilian assistance agencies in Pakistan, USAID takes a lead role in ensuring interagency coordination. Added to its internal coordination role are the necessary and daily engagements with USAID headquarters, the Office of the Inspector General, the Government of Pakistan (GOP), the Pakistani and American public, and other development partners and stakeholders. However, the Mission struggles with an extraordinarily high staff turnover rate, specifically among USDH personnel whose tours in Pakistan are typically between one and two years. The high turn-over, combined with the fast-paced operational tempo and number and complexity of programs, make it particularly challenging for Mission personnel to develop, manage, and evaluate its Foreign Aid programs. Successful implementation of USAID's Foreign Service Employee Performance Management program imposes significant burden on the Mission's USDH personnel. This burden is specifically acute during the March/April timeframe, when all USDH personnel are required to draft, edit, and review multiple annual performance documents either as rated employees or as raters (supervisors). Typically USDH dedicate significant effort towards their performance management and evaluation responsibilities during this period. However, these responsibilities divert attention away from effective and uninterrupted program oversight and management, thereby risking an impairment of, or adverse effect on, the Mission's priority Foreign Aid programs. The Mission considers this to be an unacceptable risk, given the complexity and political sensitivity of USAID/Pakistan's programs. Secondly, the recent change in performance evaluation program mandates the assistance of a highly-experienced senior advisor to provide expert advice and guidance to USDH. Therefore, the Mission requires highly-specialized services from an expert advisor to mentor, coach and assist USDH staff with their performance management and performance evaluation responsibilities. This support will not only ensure USDH employees receive fair, accurate, and meaningful performance feedback and evaluations, but more importantly, will allow USDH staff to spend less time on the performance evaluation process, which will mitigate risk that the Mission's Foreign Aid programs would be impaired or otherwise adversely effected. Due to the highly specialized nature of the skills and experience required for the Performance Management Advisor, there are only a limited number of individuals capable of meeting the minimum qualifications and successfully providing the required services. However, market research has already identified several potentially highly-qualified individuals. Therefore, full and open competition would not likely yield additional highly qualified candidates, would be unnecessarily burdensome, and may delay the provisioning of services. 6. Description of efforts made to ensure offers are solicited from as many potential sources as is practicable, and whether or not a notice was or will be publicized as required by the Federal Acquisition Regulation (FAR) 5.202 (If not, which exception to FAR 5.202 applies) Market research and knowledge indicate that only a limited number of individuals are capable of successfully providing the services, due to the highly specialized nature of the knowledge, skills, and abilities required. Market research has also identified several individuals who are known or believed to possess the required knowledge, skills, and abilities. Through limited competition, the Mission will solicit offers from at least three of these potentially highly-qualified individuals. In accordance with FAR 5.202(b) and AIDAR 705.202, an advanced notice of the proposed contract action is not required and was not publicized. 7. A determination by the Contracting Officer that the anticipated cost is fair and reasonable The estimated cost of the approximate one-month contract is $58,623.00. This estimated cost is considered to be a fair and reasonable, and is based on the position level and GS-15 (equivalent) market value established in accordance with Agency regulation. 8. Description of the market research conducted, and the results or a statement of the reasons market research was not conducted Market research was initiated by drawing upon professional networks to identify several individuals known, or believed to be, highly qualified and capable of successfully providing the required services. Further market research confirmed that at least three of these individuals are available and interested in providing the services during the required period of performance. 9. Other facts supporting the use of other than full and open competition N/A 10. Sources, if any, that expressed an interest, in writing, in the acquisition N/A 11. Statement of actions, if any, the Agency may take to overcome barriers to competition in the future Future requirements of this nature may again be solicited using limited competition. However, the high turnover of USDH staff will likely provide additional professional networks that can identify other potentially highly-qualified sources. 12.
