- Statement of Work NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Reference Number is W912QM18Q0086. The 410th Contracting Support Brigade, RCO Soto Cano AB, intends to award a sole source contract for the Deployable Refill Station (DRS-4500) for 1-228th Aviation Battalion Regiment, Soto Cano, Honduras. The 410th Contracting Support Brigade, RCO Soto Cano AB intends to make an award to Capewell Aerial Systems LLC, 4298 JEB Stuart Highway, Meadows of Dan, VA 24120. Market research was conducted and information gathered in determining this company to be the only source for this requirement. In accordance with (IAW) FAR Part 5.207(c)(15)(ii), the proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1(b)(1)(ii). This notice of intent to award is not a request for competitive proposals; however responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The justification for the sole source requirements as follows: In accordance with FAR 6.303-2: (1) Agency and Activity: 410th Contracting Support Brigade, RCO Soto Cano AB (2) Nature of action being approved: Sole source acquisition. (3) The purpose of this acquisition is to provide Deployable Refill Station (DRS-4500). (4) Justification Rationale: IAW FAR 6.302-1(a) (2) Only one source is capable of providing the required product which is Capewell Aerial Systems LLC. (5) Demonstration: The Manufacturer Aqua Lung only Sole Source Aerial Machine & Tool Corp (DBA) Capewell Aerial Systems LLC. (6) Description of Solicitation Efforts: IAW FAR 5.102(a) (2), this notice will be posted on the Government-wide Point of Entry (FedBizOpps.gov), but retained in the contract file to document the rationale for a sole source award. (7) The contracting officer has determined that the anticipated cost to the Government will be fair and reasonable based upon previous awards made for the same service. (8) Description of market research: Deployable Refill Station (DRS-4500) is used to refill the emergency breathing devices all crewmembers use for overwater operations. After speaking with the manufacturer, we've learned there is no other option or company who makes a similar device. The breathing devices are manufactured by the same company and with those being proprietary, they are only compatible with the DRS-4500. Should we begin to replace these emergency breathing devices without purchasing the DRS-4500, the newer version bottles will also not be compatible with the older model refill station. There are ample reason as to why this purchase is necessary, none more than the following. We currently have two pieces of equipment but only one working device, both are older models and no longer manufactured. If the sole working device breaks, future missions WILL be jeopardized. It is imperative we replace these devices ASAP in order to maintain readiness for future operations. It was confirmed that Capewell Aerial Systems LLC is the only company that can fulfill this requirement. (9) Other supporting facts: N/A (10) Interested Sources: N/A (11) Actions to prevent barriers that may lead to restricted consideration in the future: Upon expiration of current contract, the requirement owner will research and consider 'or equal systems' in the marketplace to maximize competition. (12) This justification is accurate and complete to the best of the contracting officer's knowledge and belief.
