- Page 1 of 3 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA244-18-AP-1341 Contracting Activity: Department of Veterans Affairs, VISN 04, Lebanon Medical Center 1700 South Lincoln Ave, Lebanon, PA 17042 Nature and/or Description of the Action Being Processed: The Lebanon VA Medical Center has a 5 year, sole source firm fixed price requirement with the Lebanon Valley Family Y.M.C.A for fitness and wellness services offered to veterans and other general Department of Veterans Affairs health improvement initiative. 2237: 595-19-1-171-0002 Estimated total Value: $330,000.00 Description of Supplies/Services Required to Meet the Agency s Needs: Services to be provided shall include orientation to the fitness center and pool, fitness classes, lifeguard services, wellness program development, operation of aquatic facilities which includes cleaning, maintenance, and support during seasonal events. Additionally, provide off-site gym/pool membership for VA patients and staff in order to allow for continued fitness and wellness activities when away from the VA campus. Statutory Authority Permitting Other than Full and Open Competition: 38 USC §523 Coordination and promotion of other programs affecting veterans and their dependents, as implemented by FAR 6.302-5(a)(2). ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 (X)(5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Department of Veterans Affairs is committed to expanding current agreements and partnerships to provide services and support to reach more Veterans and their family members. Historically, the VA and Y-USA have worked together to support the health and well-being of Veterans and their families in local communities and across the nation. In, 2015 a Memorandum of Understanding was signed between the VA and Y-USA in which both entities will work in a mutually beneficial manner to promote and enhance the health and well-being of Veterans and their families. VA has the authority to coordinate the provision of VA benefits and services (and information about such benefits and services) with appropriate programs (and information about such programs) conducted by private entities such as Y-USA, under 38 U.S.C 523. This statute would authorize that the acquisition be made through another agency or specified source as stated in FAR 6.3025-5(a) (2). The Lebanon Valley Family YMCA has a unique ability to meet the Department of Veterans Affairs and the Lebanon VA Medical Center s initiatives like Blueprint for Excellence and strategic plan goals by empowering veterans and their families to improve their health and well-being through healthy lifestyle behaviors such as weight management, being physically active, and not smoking. Strengthening collaboration within the local community and service organizations such as the Lebanon Valley Family YMCA will help the Lebanon VA Medical Center achieve the goals of improving the lives of Veterans, service members, their families, and their survivors. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Historically this requirement has been under multiple contracts (see attached) and followed the Federal Acquisition Regulation and procedures for procuring services. With the issuance of a MOA and authority 38 U.S.C. 523 only one source is deemed practicable according to the needs of the Lebanon VA Medical Center. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price will be fair and reasonable based on market rates for like services and an analysis of costs. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Collected historical and current contracts, collaborated with contracting, FPDS Searches, VIP Searches, IRS 990 review, guide-star search, charity navigator search, BBB Search, collected historical data usage, researched collaborative agreements, researched and collected Y-USA MOA, verified SAM registration, researched VA policies, directives, strategic goals, and plans, completed collaborative agreement due diligence. Any Other Facts Supporting the Use of Other than Full and Open Competition: No other vendor offers the required services fitness/wellness services as well as community membership to local area gym/pool for VA patients and employees to allow for continued off site fitness/wellness programs Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Lebanon Valley Family YMCA, dba Hanford Center; Other than Small Business; 201 North 7th Street, Lebanon, PA 17046; POC: Phillip Tipton, PH: 717-273-2691; DUNS: 047078001; EIN: 231243980. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A Sole Source approval is sought for more than one year to reduce the amount of repetitive contracts/agreement actions required to maintain uninterrupted services in return reducing the Page 2 of 3 Page 3 of 3 burden of working hours and employee costs to contracting and ultimately the customer (Lebanon VAMC). Although market research revealed other sources that might be able to operate the Lebanon VAMC wellness facility and pool, none could offer a local connection to a community wellness center through memberships provided to VA patients and employees while partnering with the facility manager to share costs and benefits.
