Description
Caregivers Liferay Control Number: TAC-18-52469 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement, Acquisition, and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm-fixed-price Delivery Order, issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V, Governmentwide Acquisition Contract (GWAC), to acquire Liferay Portal Enterprise Subscription Platinum Production Server software licenses and 24x7 software support. 3. Description of Supplies or Services: The proposed action is to provide brand name Liferay Portal Enterprise Subscription Platinum Production Server software licenses to VA Enterprise Program Management Office (EPMO) Enterprise Operations (EO) for sustainment support of the Caregivers Tool Project (CTP). The Contractor shall provide four subscriptions in the base period and 12 in each option period. Additionally, EO requires 24x7 Software support maintenance. Liferay is an open source platform used as the development tool and foundation upon which CPT is built. Included in the support maintenance is access to software patches, updates, product enhancements, and new releases. The period of performance for this procurement is nine months with two one-year option periods. 4. Authority Cited: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505 (b)(2)(i)(B), entitled Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: Based on the market research described in Section 8 of this document, it has been determined that limited competition for Liferay Portal Enterprise Subscription software and support is viable among authorized resellers of the product. VA s CTP currently utilizes Liferay Portal Enterprise Subscription software licenses to deliver a single web portal that enables the CTP framework to integrate with other technologies. Although the Liferay platform is open source, CTP utilizes a proprietary version 6.2 that has been customized specially for CTP allowing the necessary interfaces with other VA systems utilized by VA. If any other brand name was utilized for CTP it would no longer be able to integrate with the other applications within VA that use Liferay such as the My HealtheVet (MHV) platform. All of the current applications are coded to specifically interact with the customized Liferay source code. Any integration of a different software solution would result in the inability to access MHV for at least 1.5 years while additional development and integrations are created. Additionally, the reengineered MHV platform, a required integration point, is built on Liferay and if another platform were implemented, it would have to be rewritten, tested, and deployed. Additionally, VA would need to stop the current Legacy work that is currently ongoing to move onto the legacy MHC platform to the reengineered MHV Liferay platform. This would result in extensive delivery delays of up to two years and $4.4M in duplicated costs that would not be recovered through competition. These estimates are based on previous efforts for similar procurements. This would severely impact several million Veterans as MHV is the Veteran s sole resource for virtual healthcare from VA. Veterans would lose the ability to virtually access their personal health information, virtually contact their physicians, access their appointment information, and virtually refill vital medications, among all the other capabilities that MHV currently provides. Additionally, since Liferay software is proprietary, no other vendor can provide the required software maintenance and technical support as no other vendor would have access to the necessary proprietary source code. In order to continue to correct bugs or remediate security vulnerabilities in any existing/ new software, access to the source code is required. Furthermore, for this reason, no other vendors offer technical support for the product that VA can utilize to allow non-technical staff to continue to manage website content updates without intervention from the EO staff. Other software developers that offer similar products merely provide software maintenance and technical support for their own proprietary software products but not the required CTP Liferay platform. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Limited competition among Liferay authorized resellers is anticipated for the required licenses. In accordance with FAR 16.505(a)(4)(iii)(A)(1), this justification will be provided with the solicitation to all appropriate NASA SEWP V GWAC holders. Furthermore, in accordance with FAR 5.301, 16.505(b)(2)(ii)(D), and 16.505(a)(4)(iii), the award notice for this action will be synopsized on the Federal Business Opportunities website and this justification will be made publicly available within 14 days of award. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: VA s technical experts conducted market research in July 2018 to ascertain if other products would satisfy VA s requirements. Market research was conducted via the NASA SEWP V GWAC website and an independent website search using the Google search engine. VA technical experts reviewed licenses offered by other manufacturers who produce similar products and offer similar software licenses such as International Business Machines (Websphere) and Oracle (WebLogic); however, they currently do not meet all of VA s functional and interoperability requirements as outlined in Section 5 of this Justification. In September 2018, the Contract Specialist conducted market research to ascertain the extent of limited competition among resellers of the required software licenses and associated software maintenance. Through the use of the Provider Look-up tool on the NASA SEWP V GWAC website, 10 Service Disabled Veteran-Owned Small Businesses (SDVOSBs) were identified as resellers of the required Liferay Software licenses and maintenance support. Therefore, limited competition is anticipated. 9. Other Facts: None.
