- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 10 U.S.C. 2304(c)(1) Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows: 1. Agency and Contracting Activity. The Department of Homeland Security (DHS), United States Coast Guard (USCG), Shore Infrastructure Logistics Center (SILC) proposes to enter into a Requirements contract with a one-year Base Period and four one-year Option Periods (not to exceed 5 years) on a basis other than full and open competition. 2. Nature and/or description of the action being Approved. The U.S. Coast Guard has a follow-on requirement on a sole source basis for the maintenance and repair of Electron PM-1703 Gamma/Neutron (G/N) Personal Radiation Detection at an estimated contract ceiling of. Contractor: Polimaster, Inc.; Address: 2200 Clarendon Blvd., Suite 1204 Arlington VA. 22201-3379; DUNS: 172900446 3. Description of Supplies/Services. This requirement is to provide preventative and remedial maintenance for all Electron PM-1703 Gamma/Neutron (G/N) Personal Radiation Detectors (PRD) belonging to the USCG at an estimated contract ceiling of This will be a follow on to contract HSCG84-13-D-BB5042 which expires on 30 September 2018. Due to the vast presence of PRDs in the USCG inventory, the lack of USCG technicians and on hand repair parts, it is necessary for the manufacturer of the PRD's to provide preventative and remedial maintenance to the devices. Identification of Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), implemented by FAR Subpart 6.302-1 entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". 5. Demonstration that the Nature of the Acquisition Require Use of the Authority Cited. The Electron PM-1703 G/N PRDs are pocket-pager sized radiation detectors that provide rapid alert of USCG personnel to the presence of radiation threat, well before they might be exposed to health threatening levels. The PM-1703 G/N PRDs were purchased for the Maritime Radiation Protection Program to utilize by personnel during USCG boardings and inspections as a means to detect and intercept illicit radioactive material before it enters the United States. For the dual purpose of protecting personnel and increasing the chances of intercepting illicit radioactive material, PRDs are worn by all members conducting boarding and/or inspections. T hese Personal Radiation Monitors and support equipment enable approximately 5000 USCG operational personnel to determine if elicit radioactive material is present during operations. For example, the monitors are used by boarding team at USCG Sectors to determine if there are illicit materials present during the boarding inspection being smuggled onto American soil. Currently, the USCG has 7,100 PRDs in inventory and deployed throughout the USCG Fleet with an approximate value of. This contract will be used to service, repair and maintain the currently deployed and monitors in inventory allowing USCG personnel to complete their missions. Through competitive procedures, a contract was awarded for the purchase of PM-1703 G/N PRDs. Since 2004, more than 5,500 PRDs have been fielded to over 400 USCG units. These units will need to be supported until the end of their service life or until a suitable replacement is selected. It is necessary to restrict competition on this acquisition for the following reasons: (A) Only one source within the United States is capable of providing preventative and remedial maintenance on the PRDs. (B) To maintain continuity throughout the USCG and minimize the costs for parts, preventative and remedial maintenance. 6. Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential Sources as is Practicable. An Intent to Sole Source Notice was posted on the FEDBIZ OPPS website on 20 July 2018, with responses due by 3:00pm EDT on 27 July 2018. No sources responded to the notice. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. In accordance with FAR Subpart 15.404-1(b), the anticipated prices can be determined fair and reasonable based on prior acquisition history under contract HSCG84-13-D-BB5042 and Polimaster's current commercial price list. 8. Description of Market Research. Market Research included internet searches of available products. General Services Administration (GSA)/Federal Supply Schedule (FSS) 66 II Q - Scientific Equipment and Service. Although, there were nine (9) sources found none of which provides maintenance services. Polimaster is the only manufacture that services and repairs the PRD's which are currently deployed by USCG personnel. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition. This contract is for service and repairs of PRD, to support the USCG inventory of PRDs. The only available servicing and repair manufacturer of these parts is Polimaster, Inc. The previously cited manufacturer is capable of providing the required service and repairs, the only other option would be for the USCG to enter into a contract through open competition to replace damaged PRDs or those needing replacement with brand new systems. This option would create additional and duplication of costs that could not be recovered through competition, as well as greater expense in logistics management, continuity disadvantages and additional expenses associated with training and maintaining multiple systems within the USCG for the same capability. 10. A Listing of the Sources, if Any, That Expressed, in Writing, an Interest in the Acquisition. An Intent to Sole Source Notice was posted on the FEDBIZ OPPS website on 20 July 2018, requesting interested parties submit their interest to the Contracting Officer by 3:00pm EDT on 27 July 2018. No sources expressed an interest in the acquisition. 11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required. It is anticipated that future requirements for PRDs will be executed competitively as the current inventory of PRDs reach the end of their service life. At that time, a determination will be made as to how the maintenance and repair will be procured.
