- Description
- The Naval Air Warfare Center Aircraft Division Lakehurst, NJ intends to award a contract to TLD America Corporation of Windsor, CT for the manufacture and delivery of five (5) Air Conditioning Units with Heaters (Part number: 802-H-CUP or ACU 802-H-CUP) in support of the P-8A Poseidon Program. Under the authority of Title 10 U.S.C. Section 2304(c)(1), the Government intends to issue a sole source contract to TLD Corporation, as this company is considered the only responsible source capable of providing the Air Conditioning Units with Heater required for this effort. As the Original Equipment Manufacturer (OEM), TLD Corporation has proprietary rights to the engineering data and detailed product drawings, and is the sole designer, developer and manufacturer of the items above. The Government does not own the data rights and a competitive drawing package for this effort is not available. TLD Corporation is the only source that can provide the above item to the same form, fit and function that is compatible with the existing configurations and is therefore, the only vendor capable of meeting the Government requirement. THIS IS NOT AN INVITATION FOR COMPETITIVE PROPOSALS. This acquisition is being pursued on a sole source basis under the statutory authority of Title 10 U.S.C. 2304(c)(1), as implemented in FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received to this notice. A determination by the Government not to compete this requirement is solely within the discretion of the Government. Responses must be received within fifteen (15) days of publication of this notice.
