Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. Contracting ActivitY: Department of the Air Force, 452 nd Operational Contracting Office, 452 MSG/PK,1940 Graeber St. Bldg. 449, March ARB, CA 92518 II. Nature and/or Description of the Action being processed: This is a Justification for Other Than Full and Open Competition that describes the need for the HazmatID Elite equipment Basic Package Dual Diamond System P/N: 029-1001-G2, a handheld field ready Fourier Transform Infrared Spectroscopy (FTIR). This Firm Fixed Price (FFP) contract was awarded to Smiths Detection Inc., the Original Equipment Manufacturer (OEM). III. Description of the Supplies/Services required to meet the agency's needs: The HazmatID Elite is a handheld field ready Fourier Transform Infrared Spectroscopy (FTIR) chemical identification system that detects organic and inorganic solid or liquid chemicals, a tool with spectral libraries in which to identify unknown solids including polymers and rubbers and many other chemical classes. The Hazmat ID Elite is used by the Bioenvironmental Flight as a first responder capability for the detection and identification of various hazardous material classes under the Air Force Medical Service Home Station Medical Response mission. This identification system also is used by BE to respond to on base incidents that will provide protection of the base populous and ensure mission ready requirements. This unit is also equipped to support deployed counterparts in the AOR (Area of Responsibility). IV. Statutory Authority permitting other than full and open competition: The statutory authority for this action is contracting by Other than Full and Open Competition 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(b)(1)(i), "unique supplies or services available from only one or only one supplier with unique capabilities". V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (Applicability of Authority): As the OEM, Smith's Detection, Inc., is the only company that can provide the HazmatID Elite equipment Basic Package Dual Diamond System P/N: 029-1001-G2, a handheld field ready Fourier Transform Infrared Spectroscopy that will satisfy agency requirements. The Home Station Emergency Response Mission - 886H Equipment upgrade "HazMat Elite Chemical Identifier is a replacement for the current model "HazMat ID 360" Chemical Identifier which has exceeded it recognized service life cycle. To upgrade to the HazmatID Elite equipment Basic Package Dual Diamond System and not purchase from another manufacturer will provide a consistent delivery of common BE equipment capabilites for all Bioenvironmental Flights across the Air Force, establish BE equipment standards that allows BE career professional to execute capabilities without the additional burden of retraining on local equipment when changing stations or deploying. Upgrading will assist in minimizing logistics support without retraining, allow the software (library) of the Elite system to read the older files that is necessary for the FME Lab to access in order to analyze and compare them and is economically cost effective in order to meet the agency's needs. VI. Description of Efforts made to ensure that offers are solicited from as many potential sources as deemed practicable: The purpose of market research is to determine if there are commercial contractors can provide FTIR. It was determined that commericial vendors are available, however all small businesses (Madison Instrument Inc., Midac Corporation, Kemmeny Associates LLC, Designs and Prototypes, LTD, and CICP, LLC) as indentified, indicated they only tested the results and were not capable of providing the users requirement. Also, further research indentified large business (Bruker Optics, Inc., Smith's Detection, Inc., and Thermo Scientific Portable Analytical Instrument Inc.) indicated that Smith's Detection, Inc. was the sole manufacturer of the HAZMAT ID Elite as identified by the agency requirement. It was also determined through literature reviews and market research conducted by Subject Matter Experts at USAFAM and ACC/SG that Smith's HazMat ID Elite provided the overall best field portable FTIR equipment with the capability to detect, identify and quantify organic and inganic compounds, in solids and liquids, in a field environment to include corrosive/abrasive materials. VII. Determination by the Contracting Officer that the Anticipated Cost to the government will be fair and reasonable: The Contracting Officer determined the cost for this effort will be fair and reasonable and represent best value as defined in FAR 2.101 and results in the lowest cost alternative (considering price, special features, administrative cost, etc.) to meet the Government's needs. VIII. Description of the Market Research conducted and the results, or a statement of the reasons market research was not conducted: Market survey was conducted through survey from GSA and SBA websites and it was determined that there are no small businesses that can provide HazmatID Elite Equipment. These small businesses indicated that they are capable of only providing test results and not the equipment itself. IX. A statement of the actions, if any, the agency may take to remove or overcome any barriers to Competition before making subsequent acquisitions for the supplies or services required: The barriers to full and open competition for this requirement will be to continue monitoring the marketplace for developments in technology that allows manufactures to read and utilize each other's file history. XII. Contracting Officer's Certification: The contracting officer's signature on the Coordination and Approval Document evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief ( FAR 6.303-2(b)(12) ).
