MODIFICATION NOTICE: Bids are being solicited under solicitation number 70FBR218I00000003-01. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued. The solicitation is issued as an invitation for bids (IFB), unless otherwise indicated herein.If your company can provide the product/services listed on the solicitation and comply with all of the solicitation instructions, please respond to this notice. To view the specifications, please go to www.FedBid.com and reference Buy No. 938304_04. IDIQ: Sellers bidding on this opportunity MUST have the items requested on the specified contract. The contract must either be in the Seller's name or the Seller must be able to document its ability to act as an agent of a partner's contract. Sellers may offer Open Market items only in accordance with the approved Terms and Conditions of their respective contract AND approval from the soliciting contracting officer. The DHS Federal Emergency Management Agency requires the following items, Purchase Description Determined by Line Item, to the following: LI 001: REPAIR HOMES PER ATTACHED STATEMENT OF OBJECTIVES. THIS IS THE FIXED PRICE PORTION INCLUSIVE OF DIRECT LABOR, MATERIALS, TRANSPORTATION, MANAGEMENT TO COMPLETE THE REPAIRS. FOR PURPOSES OF THIS SOLICITATION ENTER A PRICE OF $100,000.00/EA FOR THIS LINE ITEM. THIS IS ROUGHLY THE PROGRAM CAP PER HOME. CONTRACT AWARD WILL NOT BE MADE BASED ON THIS PRICE. CONTRACT AWARD WILL BE BASED ON IDENTIFYING BEST QUALIFIED COMPANY OR COMPANIES FOR THIS PROCUREMENT. FEMA MAY AWARD ONE OR MORE CONTRACTS FOR THIS REQUIREMENT. This line item is for permits and contingencies that may impact the repair of the structure for example soil remediation, asbestos removal, etc., 50, EA; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, DHS Federal Emergency Management Agency intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. A Seller may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Proposals will only be considered from Puerto-Rico-based bidders residing within disaster declaration DR4339PR PUERTO RICO as defined by FAR 52.226-3c. If the offeror does not meet representation criteria of FAR 52.226-3c, he shall furnish documentation to support its representation IAW FAR 52.226-3D AND PROVIDE THAT IN HIS PROPOSAL ATTACHMENT. FAR 52.211-12 “ Liquidated Damages ”Construction (Sept 2000) (a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $100 PER DAY FOR EACH WORK ORDER for each calendar day of delay until the work is completed or accepted. (b) If the Government terminates the Contractor ™s right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause. FAR 52.211-13 Time Extensions. Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.
