- The U.S. EPA intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b)(1),with with Malvern PANalytical, Inc. for the purchase of a replacement an X-ray Fluorescence Super Sharp X-ray Tube SST R and SST(Part #9430 027 92452). The EPA's Office of Research and Development (ORD), National Risk Management Research Laboratory (NRMRL), Drinking Water Treatment Distribution Branch (DWTDB) at AWBERC, 26 West Martin Luther King Dr., Cincinnati, OH 45268 conduits aging water infrastructure research focusing primarily on the Lead and Copper Rule (LCR) which is a treatment technique regulation promulgated in 1991. The LCR requires water system to conduct tap sampling for lead and copper. DWTDB conducts sample analysis using a Malvern PANalytical X-ray Fluorescence Spectrometer (XRF), which needs a replacement Super Sharp X-Ray tube to be installed SST R and SST. The tube identified above is a direct replacement of the one installed within the instrument when it was originally purchased, as such, its performance specifications are made to match that original tube. This is critical for the following reason: 1) Over the past decade the laboratory has developed a large host of analytical data derived from the analysis of hundreds of samples. Accurate comparisons of past data with future data can best be achieved by minimizing variations created by instrumental operating parameters; 2) The performance of other instrument sub-systems, e.g. signal detectors are tied closely to the performance of the tube which is generating the energy needed to create the signals. Variations in the tube specifications can create a situation where the data signal lies outside the adjustment range of the detectors; and 3) The performance of the instrumental operating software is tied closely to the manufactured specifications as well as the changes expected over time. A tube that does not match expectations may become progressively harder to adjust for. Malvern PANalytical does not recommend, approve or have agreements with third parties and are not liable for situations including and defect, damage of other subsystems, user safety, inaccurate data collection or analysis arising from any parts or items that have not been manufactured by Malvern PANalytical. Based on the critical reasons identified above, it is in the Agency's best interest to purchase the Malvern PANalytical replacement part directly form the manufacturer. This procurement will be accomplished under FAR Part 12 Commercial Procedures using Far Part 13, Simplified Acquisition Procedures. It is our intent to award a single fixed price purchase order. Interested firms may identify their interest and capability to respond to the requirement. Sources wishing to be considered MUST submit documentation to the office identified in this notice. Documentation must be submitted within 15 calendar days of the date of publication of this notice. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETATIVE QUOTATIONS. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government.
