- Pre – Solicitation/Special Notice Expert Witness W912BV19Q0006 This is a notice of intent that the U.S. Army Corps of Engineers, Southwestern Division (SWD), Tulsa District (SWT) intends award a sole source commercial service purchase order to Trauner Consulting Services, Inc. for services of an expert to support the Government in defending a current claim. USACE, Tulsa District is analyzing and responding to a July 2018 claim submitted by construction contractor, Gilbane Federal, and preparing for Alternative Dispute Resolution, consolidation of this claim with two previous claims, and probably litigation. The claim includes allegations related to the construction of an air control tower at Vance AFB, including cost and schedule impacts. In order to evaluate the new claim and prepare the Government’s defense for ADR and trial, the Government requires a consultant to perform review and analysis of the scheduled progress and/or delay on the Vance air traffic control tower project. The consultant contractor (“Consultant”) is an expert in scheduling and claims analysis and possesses the credentials necessary to qualify as an expert before the Armed Services Board of Contract Appeals and Federal Circuit Court. Options include preparation for ADR and attendance at ADR as an expert, preparation of a Rule 23 Expert Report, attendance at depositions, and trial, and assistance in any post-trial briefing. The period of performance for the base bid is one (1) year (365 calendar days) from the date of contract award, with deliverables due as set forth in the Performance Work Statement. The period of performance for each Option is one (1) year (365 calendar days) from the date the Option is exercised, with deliverables due as set for in the Performance Work Statement. The Federal Acquisition Regulation allows for the submission of capability statements from prospective offerors to show interest which shall be considered by the Tulsa District, U.S. Army Corps of Engineers. This is not a request for capability statements or quotes. However, the Tulsa District, U.S. Army Corps of Engineers will consider any capability statements or quotes submitted by all responsible sources. Depending on the evaluation result of the capability statements, the Contracting Officer will determine whether this sole source action is justified or a solicitation should be issued to interested firms. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Contracting Officer. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No requests for capability briefings will be honored as a result of this notice. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. If potential offerors choose to submit information, past performance and references regarding capability to perform these services must be provided along with the statement of capability. The Government will not award a contract based on the information received, nor reimburse participants for information they provide. Information provided is strictly voluntary.
