Description

The National Institutes of Health (NIH), The National Institute of Allergy and Infectious Diseases (NIAID) intends to negotiate on an other than full and open basis with the vendor Becton, Dickinson and Company, 2350 Qume Drive, San Jose, CA, 95131 for preventive maintenance to maintain proper functionality of a 1). FACSAria Fusion SORP (No Lasers), Serial # R65828200066. Coverage includes the BD FACSAria Fusion Special Order System and one BD FACStation (excluding printers) for labor, travel expenses and parts (excluding lasers and consumables items), for the following: Two (2) Preventive Maintenance Inspections to be performed during a twelve-month period including 2 PM Kits, software revisions released during the Agreement term, unlimited service visits, Monday-Friday, excluding BD Bioscience holidays, unlimited telephone support for instruments, reagents and applications will be provided at no additional charge. Every reasonable effort will be made to respond within 48 hours to a request for emergency on-site (Monday through Friday, excluding BD Biosciences holidays). Becton, Dickinson and Company is the Original Equipment Manufacture and does not authorize any third party vendors to conduct maintenance services on their equipment, in accordance with their required specifications, and have certified technicians and parts to maintain the equipment and therefore subcontracting possibilities are not an option. The anticipated period of performance is for a base year plus 4 one year option periods. The statutory authority for this sole source requirement is 41 U.S.C. 253 (c) (1) as implemented by FAR 6.302-1 only one source available, no substitutions possible, and replacement parts must be compatible with existing equipment. THIS IS NOT A REQUEST FOR PROPOSAL. All responsible sources that can provide these services may submit a response that will be considered. The response should include the certification from Becton, Dickinson and Company that you are authorized to obtain OEM parts to maintain the above reference equipment. Also provide past performance demonstrating the successful performance of this type of services. All responses in writing shall be submitted to Lawrence Bland Jr. blandl@mail.nih.gov. All responses received by the closing date will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
