- The Naval Air Warfare Center - Aircraft Division Lakehurst, NJ, under the authority of 10 USC 2304(c)(1), FAR 6.302-1, intends to award a Firm-Fixed Price type contract, on a limited competition basis, between The Boeing Company Seattle, WA (Cage Code: 81205) and its authorized manufacturers for the manufacture of P/N G28023-62, Auxiliary Tank Test/Recovery Defuel Equipment. The estimated quantity is twenty (20) base units. This procurement is required to support the P-8A Poseidon Program for the United States Navy (USN), Royal Australian Air Force (RAAF) and Foreign Military Sales (FMS) customers. The quantities fill current deficits for the USN, RAAF and UK FMS. The above support equipment was designed by The Boeing Company based on specific proprietary requirements for the Boeing class 737, thus P-8A, that the Navy does not have access to. The Boeing Company owns all proprietary rights to the engineering data and detailed product drawings. The Boeing Company and its authorized manufacturers is the only manufacturers with the unique technical expertise to supply these items. An adequate purchase description or other information suitable to solicit by full and open competition has not been developed because the Government does not have sufficient engineering data or drawings to organically design the above items and enable a competitive procurement. The Boeing Company and its authorized manufacturers are the only source that is capable of providing the above item to the same form, fit and function that is compatible with the existing configurations. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, the Government will consider all responses received within fifteen days after the date of publication of this synopsis. Registration in the System for Award Management (SAM) (https://www.sam.gov) is mandatory for consideration. A determination by the Government not to open the requirement to competition based on the responses to this notice will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
