Description
Notice of intent to issue a sole source contract for solid waste hauling and disposal, North Cascades NPS Complex, Stehekin WA. In accordance with FAR Parts 5.2 and 6.302-1 this notice advertises the government's intent to negotiate and award a sole source contract for solid waste hauling and disposal services. The National Park Service (NPS), North Cascades National Park Service Complex (NOCA), intends to negotiate and award a sole source contract for collection, transport, and disposal of solid waste from NPS facilities at the NOCA Stehekin site. Solid waste and recyclable materials generated in the Stehekin valley must be barged to Chelan, WA, for disposal. The Washington Utilities and Transportation Commission regulates solid waste collection companies in the state and assigns and issues Solid Waste Company Certificates and Tariffs. At this time, Mountain Barge Services, LLC (formerly Stehekin Maintenance & Machinery), holds the certificate of public convenience and necessity (Certificate G191, G000191) for Stehekin, WA. We intend to negotiate a contract for a base year plus possibly up to four option years, for a total contract period of not to exceed five years (base period upon initial award to 11/30/2020 and option years 12/1 to 11/30, through 11/30/2024). Date: January 15, 2019 PR Number: FBMS Requisition # 40471478 NOCA: R9473203001 Identification of the Agency and the Contracting Activity: Department of Interior, National Park Service (NPS), Pacific West Region, North Cascades National Park Service Complex (NOCA). 1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost): This justification seeks approval for North Cascades National Park (NOCA) to negotiate and award a sole source contract for transportation, and disposal services of solid waste and recyclable materials in accordance with FAR 6.302-1 and 41 U.S.C. 253(C) (1) to Mountain Barge Services LLC of Chelan, WA. Solid waste removal services in the State of Washington are regulated by the Washington Utilities and Transportation Commission, a state agency. WUTC regulates the rates, services, and practices of privately-owned utilities, including solid waste collection companies. The Commission regulates utilities under authority granted in Title 81.77 of the Revised Code of Washington (RCW), implemented in Washington Administrative Code (WAC) 480-70. Mountain Barge Services LLC holds Certificate of Public Convenience G000191 and is currently the only authorized vendor to provide solid waste removal services in the required collection area (Stehekin, WA). The contract is for collection, transportation, and disposal services of solid waste (trash/garbage) and recyclable materials generated in Stehekin, WA. The Contractor will pick up compacted and containerized or loose solid waste and recyclable materials from the NPS solid waste facility (located approximately 4-1/2 miles northwest of the Stehekin landing on a hard-surfaced road), transport by truck, trailer (or roll off containers) to Stehekin Landing, transport them by barge out of Stehekin and down Lake Chelan, and then transport them to the appropriate solid waste transfer station and/or certified recycling collection centers in Chelan or Wenatchee, WA. The contractor will be required to transport some materials in NPS-owned 30 cubic yard roll off containers using a compatible truck tractor owned by the contractor. The contract will include one base period and up to four option years for a total performance period not to exceed five years. The estimated value is expected to be approximately $49,000 for the base year and not to exceed $250,000 for base and all option periods. 2. Sole Source Justification rationale (Check one and explain below): X Only one responsible source. _Urgent and compelling circumstances exist. _Other Explain: Stehekin, Washington is a remote wilderness community, located within Lake Chelan National Recreation Area, a unit of North Cascades National Park Service Complex. It is 55 miles up Lake Chelan from Chelan, WA, and cannot be reached by car (vehicles on roadway), but can be reached by boat or plane (usually by ferry or barge service). Coordination with a barging service will be necessary to transport refuse material from the Lake Chelan National Recreation Area to the Chelan/Wenatchee, WA area for disposal as barging is basically the only option for transporting the solid waste/recycle/loose materials. There is only one company that currently provides barging services from Stehekin and they also have been issued a WUTC permit to operate as a business doing Solid Waste Collection Services in the Stehekin area. The entity is: Mountain Barge Services, WUTC Solid Waste Company Tariff Permit # G0001913. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest: Market research was conducted by the Contracting Officer (CO) as required by FAR Part 10, to verify the aforementioned factors are accurate. 4. If this is a determination for sole source, the Contracting Officer certifies: a. Only one source is available, or urgent and compelling circumstances exist. b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
