Description
This is a SOURCES SOUGHT NOTICE for market research purposes.� THIS IS NOT A REQUEST FOR PROPOSALS OR A REQUEST FOR QUOTATIONS. In order to comply with the U.S. Department of Commerce (DOC)/National Institute of Standards and Technology (NIST) counsel recommendation (May 2004) and in order to fulfill the United States� World Trade Organization (WTO) Member obligation under the Technical Barriers to Trade Agreement (TBT), the U.S. WTO TBT Notification Authority, located at NIST in the Standards Coordination Office (SCO), is required to notify the WTO of changes in U.S. technical regulations and conformity assessment rules at the Federal and sub-central (State) level. To fulfill this obligation, SCO requires a specialized legislation and regulations information service, to monitor and alert NIST of proposed State regulations, from the 50 states and the District of Columbia, that could be potential barriers to trade. Required Information for Submission NIST is seeking responses from all responsible sources. Small businesses are defined under the associated NAICS code for this effort, 519190, All Other Information Services, as those domestic sources having annual revenues of $35.0M or less. After the results of this market research are obtained and analyzed, NIST may conduct a competitive procurement(s) and subsequently award a contract. If at least two qualified small business are identified during this market research stage, then a competitive procurement would be anticipated to be conducted via a small business set-aside. If a small business set-aside results, a Limitation Subcontracting clause will be applicable to the anticipated procurement action. Businesses meeting the classification of the set-aside would be required to perform 50% of the labor for the required work with qualified in-house personnel. Sources must maintain adequate staff to perform the work in-house. Responses to this sources sought shall not exceed 15 pages in length (exclusive of screenshots), and shall demonstrate the respondent�s capability to perform the anticipated work. The response must provide detail well beyond a simple statemnt that a respondent is �capable.� Documentation submitted shall address all of the following: -Capability to track and monitor U.S. state regulatory actions, proposed, enacted, and revised, as well as state legislative proceedings (introduced, implemented, subsequent action, signed by governor, revised) for all 50 states, for non-agricultural manufactured goods and products, and for agricultural products or food products, when marking, labeling, grading, or packaging is at issue.� -Capability to email reports on a daily basis relevant to introduced legislation, relevant proposed and final regulation, and bills that are signed by governors. -Capability to perform customized, manual analysis, filtering, and review to identify items relevant to NIST and screen out items not relevant to NIST. -Capability to continue tracking bills and regulatory items NIST is already tracking. -Provide service with no limit on the number of bills and regulations that are tracked, as well as keywords or phrases used to identify and track legislation and/or proposed and final regulation that may be relevant to NIST. -Capability to utilize a list of keywords and phrases and use it to immediately begin tracking legislation and regulatory activity relevant to NIST. -Capability to revise and add new search terms used to screen (proposed) regulation and legislation of interest to NIST. -Capability to provide login access and credentials for access to web-based information for no less than four simultaneous users. -Capability to, on a daily basis, manually create, a list of bills, legislative and regulatory actions that are potentially relevant and non-relevant to NIST, using automated keyword searching and Boolean operators, while screening out and documenting the items that were judged not relevant to NIST.� -Capability to connect regulatory or legislative actions that NIST has previously notified, and/or notifies after services commences, to directly related subsequent regulatory and legislative activity at the proposed, adopted and revised stages. -Capability to access a Web-Based Interface. -Discuss potential subcontractor and/or teaming arrangement�s that the respondent would consider beneficial in performing the anticipated work. -Provide screenshots of pertinent features and/or provide a password to a �test� site that the Government can utilize to view the capabilities identified above; -Comments or concerns associated with the contemplated award of a firm fixed price contract to complete the required work; -An estimate of the price to complete the required work. The Contractor may provide an estimated range for the price. This estimate will be utilized for budgeting purposes. Therefore, it is preferred that the range be within 15% of the total estimated price.
