Description
The Office of Acquisition and Agreements Management (OAAM), Acquisition Management Division (AMD) of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole source basis, under the authority of FAR 13, with Sony Biotechnology Inc. of San Jose, CA, to acquire a 561nm laser � an upgrade of the Sony SH800 Cell Sorter. The Cell Systems Science Group (CSSG) within the Biosystems and Biomaterials Division of MML contributes to the new post-genomic era with research in measurements and models that support the understanding of complex biological phenomena at the cellular and subcellular levels. The group focuses on the cell as a system and tools that can make measurements and characterize the system properties. This is achieved through bioimaging and other cytometry techniques, measurements that assess protein and gene function within living cells, experimental design, and bioinformatics. The 561nm laser, an upgrade to the NIST owned Sony SH800 cell sorter, will expand the capability of the existing instrument and allow NIST scientists to pursue the measurements required to carry out research on biological phenomena.� The upgraded instrument will serve a vital role in innovative work on measurements in support of the NIST mission by allowing evaluation of more than one fluorophore in individual cells. The NAICS code for this requirement is 334516 and the small business size standard is 1,000 employees. Sole source determination is based on the following: Market research revealed that Sony Biotechnology Inc, is the only source that can provide a commercially available 561nm laser that meets NIST�s minimum requirements. Sony Biotechnology has proprietary rights to the existing equipment and any upgrade. They have no authorized resellers or service providers, therefore, only they can supply the 561nm laser upgrade. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 11:00AM EST February 18, 2020 will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
