- The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b) (1), with Malvern Panalytical, Inc. located at 117 Flanders Rd., Westborough,�MA,�01581 a Service Contract for a Malvern Panalytical Empyrean X-Ray Powder Diffractometer for the Materials and Structural Systems Division �(MSSD) at NIST, Gaithersburg, Maryland. The Materials and Structural Systems Division is involved in the analysis, standards and codes involving a wide range of construction materials, including cement clinker, cement, fly ash. blast furnace slag, and aggregate. NIST MSSD is seeking a service and maintenance contract for the existing Empyrean X-ray Powder Diffractometer,� which is used to study crystalline and non-crystalline mineral, hydraulic cement, fly ash, slag, clays and other materials by qualitative, quantitative, and non-ambient analyses, as well as polymeric materials in bulk and composite films for coatings using multiple geometries, �to ensure uninterrupted performance and support of the groups mission. The Empyrean X-Ray Powder Diffractometer (SN 1855) is proprietary to its original equipment manufacturer, Malvern Panalytical, Inc., and maintenance support services may only be purchased and performed directly from the manufacturer, Malvern Panalytical.� No other contractor has the capability or OEM authorization to service this proprietary equipment or to provide compatible replacement parts when needed. Use of any other contractor for the required support services would jeopardize equipment function and reliability as well as introduce proprietary technology to an unauthorized technician or company. Accordingly, only Malvern Panalytical, Inc. is capable and authorized to provide the services, parts, and access to the proprietary equipment. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by February 20, 2020 will be considered by the Government.� All responses to this notice of intent must be submitted via email to January.Magyar@nist.gov so that they are received no later than February 20, 2020 at 5:00 PM Eastern Time. Each response should include the following Business Information: a. Contractor Name, Address, b. Point of Contact Name, Phone Number, and Email address c. Contractor DUNS d.
