- The National Institute of Allergy and Infectious Diseases, National Institutes of Health intends to negotiate on an other than full and open competition basis with Thermo Fisher Scientific, Asheville LLC, Bldg. 2 B, Suite 400, 28 Schenck Parkway, Asheville, ND 28803 a service �maintenance agreement for Thermo Fisher Scientific Heracell CO2 incubators and various models of Sorvall centrifuges a total of seventy-nine (79), see attached equipment list.� FAR Part 12 � Acquisition for Commercial Items and FAR Part 13 -� Simplified Acquisition Procedures will be used for this acquisition.� This acquisition will be made pursuant to the authority in FAR Part 13.501(a)(1). Only one award will be made as a result of this solicitation.� This will be awarded as a firm-fixed price type of contract. Period of performance is for one (1) year starting March 2, 2020 � March 1, 2021.� Services shall be performed in Bethesda, Maryland 20892. The Vaccine Research Center (VRC) conducts research that facilitates the development of effective vaccines.� The Heracell CO2 incubators (quantity 53) and various models of Sorvall centrifuges (quantity 26) are used in direct support of critical research being performed throughout the various VRC labs.� The majority of the equipment is fifteen (15) years of age, which of the seventy-nine (79),� twelve (12) are covered under warranty.� The need to have the incubators and centrifuges well maintained and fully functional is paramount to maintaining the flow of research activities within the VRC labs.� Thermo Fisher Scientific provides certified and factory trained engineers with expertise to service these instruments and provides immediate technical support and repair services to prevent downtime in the event the instrument malfunctions.� The impact to the program�s mission if Thermo Fisher Scientific does not service these instrument could be severe if a component fails, or if serviced with parts that are not genuine to Thermo Fisher Scientific.� The requested coverage of the service maintenance agreement for Heracell CO 2 incubators and the various models of Sorvall centrifuges consist of the following: priority onsite repair Monday through Friday during the hours of 8am to 5pm, annual onsite preventive maintenance, all labor, parts and travel time covered, priority depot repair, and unlimited priority phone and e-mail support.� As the original equipment manufacturer (OEM) Thermo Fisher Scientific, must maintain the equipment of Heracell CO2 incubators and various models of Sorvall centrifuges in accordance with its required specifications.� Thermo Fisher Scientific has proprietary rights to the design and software utilized, and it the only company with access to performance verified OEM component parts, spare parts, software, technical support, upgrades and engineering resources to maintain the original operating specifications.� To use a different vendor and parts may cause the instruments to not be calibrated to optimal specifications such that the samples between experiments will not be analyzed and compared.� Quality of experimental results may be compromised and time lost due to repeated experiments to confirm experimental results.� While under a service maintenance agreement and warranty any repairs and modifications made by anyone other than an authorized Thermo Fisher Service Representative the service maintenance agreement and warranty would be null and void. � The statutory authority for this sole source requirement is 41 U.S.C. 253 (c) (1) as implemented by FAR 6.302-1 only one source available, no substitutions possible.� THIS IS NOT A SOLICITATION FOR COMPETITIVE QUOTATIONS.� All responsible sources who can provide the required service maintenance agreement may submit a response that could be considered by email (subject line to reference NIAID-NOI-20-2002225) to Tonia Alexander at talexander@niaid.nih.gov, by 11:00 am eastern standard time Monday, February 24, 2020.� All information furnished must be in writing and must contain sufficient detail to allow NIAID to determine if it can meet the above specifications described herein.� All responses received by the closing date of this solicitation will be considered by the Government.� A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.� Any responses received by NIAID after this date and exact time specified is late and will not be considered.�
