- This NOTICE OF INTENT TO AWARD A NON COMPETITVE CONTRACT is conducted in accordance with Federal Acquisition Regulation (FAR) Part 12, Commercial Items and FAR Part 13.5, Simplified Procedures for Certain Commercial Items. The authority for this award is FAR 6.302-1 ""Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."" The Office of Personnel Management (OPM) intends to negotiate on a sole source basis with IBM Corporation, IBM Resiliency Services, PO Box 700, Suffern, NY 10901-0700 for continued Disaster Recovery services for the Chief Information Officer's Data Center.� Specifically, OPM�s Chief Information Officer has a requirement for Business Continuity and Recovery Services, to include equipment and software, support services, telecommunications services, and facilities to replicate OPM's existing environment, to enable OPM to perform its critical business and information processing activities. The services to be provided by IBM are categorized as IBM Resiliency Services, a portfolio of IBM service offerings to allow operations of business without interruption. The services also continue IBM's support of the OPM Data Mirroring environment, which consists of OPM owned equipment and telecommunications services hosted at an IBM facility, and which are to be connected directly to IBM equipment at the recovery site in a disaster scenario.� The support will be provided over a six-month period.� IBM is the only vendor with the established data mirroring environment capable of connecting directly to provide OPM with the necessary disaster recovery services. The North American Industry Classification System (NAICS) Code for this requirement is 541519. THE PURPOSE OF THIS NOTICE IS TO SATISFY THE REQUIRMENTS OF FAR SUBPART 5.2. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, all responsible parties who identify their interest and capability to satisfy this requirement will be considered. No solicitation will be issued, therefore, all requests for the solicitation will be considered non-responsive. A determination not to compete this action based upon responses received is in the sole discretion of the Government.
