Description
This is a SOURCES SOUGHT notice to address the potential use of Project Labor Agreements (PLA) for a large scale construction project within the Martin, KY area by the U.S. Army Corps of Engineers (USACE) Huntington District. �This notice does not constitute a solicitation announcement, nor does it restrict the Government to an ultimate acquisition approach.� No solicitation or technical scope of services is available at this time.� The Government will use the responses to this SOURCES SOUGHT notice to make acquisition decisions.� The U.S. Army Corps of Engineers, Huntington District, anticipates future construction work would occur in Martin, Kentucky and construction generally consists of placement of fill from Mayo Hollow site to a specified elevation (removed from flood risk) in the area situated between KY-1428 and base of the mountain forming the valley wall of Beaver Creek at the Town of Martin. Raising existing KY-1428 and existing Ice Plant Hollow Road to accommodate and serve the Phase II site and the residents of Ice Plant Hollow and to maintain traffic through the area. Construction and/or adjustment of certain utilities necessary to accommodate the project and provide for future services at the Phase 2 Redevelopment Site. Final grading and reclamation of the Mayo Hollow borrow site. Some items of work include: Demolition of existing structures in the downtown area including the retirement community. Demolition of the Water Street Bridge. Relocation of Utilities. Decommissioning and Reconstruction of Utilities. Construction of Final KY-1428 and side streets. Construction of a wetland at Mayo Hollow from existing sediment pond. Construction of Retaining Walls and a Temporary Detour for KY-1428. Filling the downtown Area. Construction of new Drainage System, including the burying of stream from Ice Plant Hollow to Beaver Creek. Construction of a new lift station in the newly developed green space. A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C 158(f). Federal Acquisition Regulation (FAR) Policy: (a) Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. (b) An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) Advance the Federal Government's interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) Be consistent with law. Reference: Provision: 52.222-33 Notice of Requirement for Project Labor Agreement Clause 52.222-34 Project Labor Agreement. Request responses to the following questions: 1. Do you have knowledge that a PLA has been used in the local area on projects of this kind? If so, please provide supporting documentation. 2. Are you aware of skilled labor shortages in the area for those crafts that will be needed to complete the referenced project? If so, please elaborate and provide supporting documentation where possible. 3. Are you aware of time sensitive issues/scheduling requirements that would affect the rate at which the referenced project should be completed? If so, please elaborate and provide supporting documentation where possible. 4. Identify specific reasons why or how you believe a PLA would advance the Federal Government's interest in achieving economy and efficiency in federal procurement. 5. Identify specific reasons why you do not believe a PLA would advance the Federal Government's interest in achieving economy and efficiency in federal procurement. 6. Identify any additional information you believe should be considered on the use of a PLA on the referenced project. 7. Identify any additional information you believe should be considered on the non-use of a PLA on the referenced project. 8. Have you ever used a PLA for a construction project? If so, what was the project (dates & location)? Will a PLA impact the cost of submitting an offer? 9. Will the use of a PLA produce management-labor stability on this project? 10. Are you aware of examples of labor-management conflicts in the area which could affect the efficiency of this project, which a PLA could positively impact/resolve? 11. Will use of PLA be conducive to ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards and other relevant matters? 12. The project will require multiple construction contractors and/or subcontractors employing workers in multiple crafts or trades. How are you going to fulfill your labor needs? 13. Will the use of PLA impact the ability of potential offerors and/or subcontractors to meet small business utilization goals? This is NOT a Request for Proposal and does not constitute any commitment by the Government. Responses to this labor market survey will be used by the Government to make appropriate acquisition decisions. All interested sources must respond to future solicitation announcements separately from responses to this survey.
