- DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($3K to $250K) Acquisition Plan Action ID: 36C260-20-AP-0334 Contracting Activity: Department of Veterans Affairs, Network Contracting Office 20 (NCO 20) 5115 NE 82nd Ave, Suite 102, Vancouver WA 98662, on behalf of, VISN 20, 663 Medical Center, R&D Service, Seattle VAMC Warehouse 90D 1660 S. Columbian Way Seattle, WA 98108-1597 PR# 663-20-1-163-0072 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: One base year plus 4 option years maintenance agreement on VA owned, R&D laboratory equipment: Coherent Chameleon Ultra II Laser System. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Technology is proprietary to the contractor. Manufacturer statement reads, Coherent, Inc. is the sole manufacturer of the Chameleon laser and only Coherent certified Service Engineers are authorized to service the equipment to ensure quality control in the repair process. Coherent does not authorize service performed by 3rd party providers . See briefcase file for full letterhead statement which identifies Chameleon/Coherent Inc. as the sole authorized personnel able to complete requested service due to the proprietary nature of the software and equipment. Description of market research conducted and results or statement why it was not conducted: VIP search under NAICS code 811219 190 SDVOSB/VOSB vendors that could possible fulfill the requirements of PR# 663-20-1-163-0072. A sources sought notice was sent to the 190 vendors of these vendors none responded that they were able to fulfill the requirements of PR# 663-20-1-163-0072. A search of the SAC revealed no items that met the requirements for this procurement. Upon email inquiry to vendor/MFG, Coherent INC., it was confirmed that Coherent INC. is the only authorized service provider able to perform the work requested due to the proprietary nature of the laser in use at the Seattle VA facility. Contracting Officer's Certification: The statutory authority for restricting competition under SAP, or Single Sourcing, for acquisitions not greater than $150,000 or Simplified Acquisition Threshold (SAT) is 41 U.S.C. 1901), as implemented by FAR 13.106-1(b)(1). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3.
