- REQUEST FOR INFORMATION (RFI) DEVELOPMENT AND IMPLEMENTATION OF A REGULATORY INFORMATION MANAGEMENT SYSTEM (RIMS) FOR THE LIBERIA ELECTRICITY REGULATORY COMMISSION (LERC) 1. Background The United States of America, acting through the Millennium Challenge Corporation (�MCC�), and the Government of Liberia (the �Government� or �GoL�) have entered into a Millennium Challenge Compact dated October 2, 2015 to help facilitate poverty reduction through economic growth in Liberia (the �Compact�) in the amount not to exceed Two Hundred Fifty-Six Million Seven Hundred Twenty-Six Thousand United States Dollars (US$256,726,000) (�MCC Funding�). Liberia�s Compact entered into force on January 20, 2016 and it expires on January 19, 2021, which is the Compact End Date. The goal of the Compact is to reduce poverty through economic growth. Specifically, the Compact seeks to address two binding constraints to economic growth currently existing in Liberia: a) lack of access to reliable and affordable electricity, and b) inadequate road infrastructure Under the Energy Project, the Compact covers funding for support for the standing up of an independent electricity sector regulator, the Liberia Electricity Regulatory Commission (LERC). The Government, acting through MCA-L, intends to apply a portion of the MCC Funding to eligible payments under a contract for the Development and Implementation of a Regulatory Information Management System (RIMS) for LERC to improve its internal processes, regulate the operational and financial performance of licensees, and facilitate the acquisition of information and data on regulated entities. 2. Liberia Energy Sector an Overview Having reestablished electricity services in key areas of Liberia�s capital city, GoL�s objectives in the power sector have shifted, since 2012, from providing emergency power to communities in the capital and its environs to nationwide development of the electricity sector in a sustainable manner through the expansion of the grid and the improvement of electricity services. The GoL has adopted an ambitious strategy to increase electricity coverage target to 70 percent of the population in Monrovia and 35 percent nationwide by 2030. In 2015, the GoL ratified the Electricity Law of Liberia hence establishing the Liberia Electricity Regulatory Commission (LERC) as the institution having legal responsibility to issue standards and regulate Liberia�s electricity sector. 3. Development and Implementation of a Regulatory IMS Pursuant to its responsibilities as defined by the 2015 Electricity Law of Liberia �the Electricity Law�, the LERC recognizes the need to automate its internal processes and to systematize the process of data collection from regulated entities, through an appropriate Regulatory Information Management System (RIMS). This system would ensure that data is collected at required periodicity and in a consistent format to enable meaningful analysis and reduce the scope of discrepancies and information asymmetry between the LERC and regulated entities. Preparatory to the development of the RIMS, MCA-Liberia has engaged an individual Consultant to establish information requirements for LERC, develop TOR including Purchaser�s Requirements as part of procurement documentation, provide technical advice during bids evaluation and provide technical oversight during the development and implementation of the Regulatory Information Management System (RIMS). Further to the foregoing, the RIMS shall possess the following capabilities: a. capable of interfacing real - time with the IMS of LEC in the immediate and with the IMS of other regulated entities in the future and facilitating the sharing of relevant information in the public domain among licensees and stakeholders in the electricity sector; b. capable of facilitating benchmarking with comparable entities to determine efficiency targets for the regulated entities; c. capable of archiving fore listed information and data for future reference in order to enhance transparency and improve stakeholder participation; d. capable of managing the internal processes of the LERC including centralizing the Board information and documentation as well as including administrative and financial processes and delineating non-public and public access; e. capable of allowing the integration and easy (ideally: automated) placement of the chosen relevant information, data and statistics in the formats defined by LERC on the to-be-established website of LERC; f. be compliant with the requirements under the Electricity Law, i.e. reflect the intention of progressive unbundling of electric power utilities. Firstly, functionally, in terms of identifying various activities� KPIs as well as costs, revenues and investments applicable to the regulated activities, as delineated by six (6) types of electricity licenses (Generation, Transmission, Distribution, Import & Export, Trading and Transmission System Operation) to be issued by LERC in future; g. be compliant with the information requirements of ECOWAS, particularly these defined by ERERA; h. encompass the scope of KPIs already developed for LERC by the Technical Assistance streams and function for ease of revisions to accommodate future headline requirements and activities. 4. Summary Scope of Works MCA-Liberia intends to procure a firm to develop and implement a Regulatory Information Management System (RIMS) for LERC. The firm shall supply and install all hardware, software, and ancillary devices necessary for the deployment of RIMS. RIMS is expected to provide a solution that automates LERC�s internal processes and enables LERC to monitor compliance, regulate the operational and financial performance of the licensees and facilitate the exchange of relevant information and data with regulated entities. The immediate requirement of RIMS as per this assignment is to (i) automate LERC�s internal processes and (ii) interface with the Executive Information Systems and dashboards of LEC or similar system that summarizes key operating and financial data and key performance indicators, including but not limited to asset register and values, supply and demand and other operating statistics, commercial statistics, budgets, financial statistics including costs of capital, demand forecasts, system plans, benchmarks, power tariffs, etc. 5. Indicative Tasks The Scope of Service comprise the required tasks for the development and implementation of the RIMS. The main tasks identified under this assignment are as follows: � Review and Analysis of Requirements � RIMS Development (Software Design and Coding/Customization) � Hardware Supply and Installation � Testing � Implementation, Integration and Deployment � Support and Maintenance � Training 6. Purpose of this Request MCA-Liberia initially issued a Request for Information in July 2019 and received responses from interested firms but was unable to launch the procurement. MCA-L now intends to launch this procurement within the next 60 days. In this regard, MCA-Liberia wishes to know if the firms that previously responded to the RFI remain interested and prepared to implement this assignment. In addition, MCA-L will appreciate if interested firms can highlight the implementation risks and the necessary mitigation measures required to ensure effective delivery of this assignment in view of the global COVID - 19 pandemic and the imminent Compact End Date (as indicated above). In pursuit of this, MCA-Liberia also request eligible Software Companies and IT Firms that meet the following criteria, but did not initially respond, to also submit their interest and profile with the following details and information. a. Minimum ten (10) years of experience in providing ICT consultancy services. b. Minimum seven (7) years of experience working with information systems in the corporate and public sectors. c. Successfully completed at least two (2) similar assignments involving information/data management for large public sector ICT projects. d. Knowledge of regulatory framework and regulatory information requirements in a comparable operating environment to Liberia�s electricity sector. e. Experience working in developing countries preferably Sub � Saharan Africa. f. Brief narrative on the scope of work of similar assignments implemented with their contract values, and g. Budgetary costs with indicative implementation timeline for the proposed scope of works and indicative tasks mentioned above. Take important note that, by publishing this RFI; MCA-Liberia seeks to know if and how this system can be developed and implemented within a 90-day period based on the background information contained in this document and the relative risks due to the global pandemic and the imminent CED 7. The intention of MCA-Liberia is to obtain information on the capability and interest of local, regional and international firms in undertaking this assignment. Based on the information received, MCA-Liberia will assess the capability of the market to respond to the proposed procurement and subsequently release a request for proposals or bids. This is not a Request for Proposals or Bids. MCA-Liberia is not herein requesting the submission of proposals or bids in response to this Request for Information (RFI). The purpose of this RFI is to obtain information from interested firms in order to assess market interest and capacity to undertake the assignment in view of the Pandemic. This RFI does not obligate MCA-Liberia to release a Request for Proposals or Bids or award a contract, nor does it commit MCA-Liberia to pay for any costs incurred in response to this RFI. Firms that responded to our earlier RFI, released on July 24, 2019, are requested to express their continued interest in providing the services in the context of the COVID-19 pandemic. They need not submit the information requested in item 6, above.
