The following information is a summary of the acquisition planning: In submitting this request for procurement, the customer considered available sources within the agency, any government furnished information/property, and security considerations IAW VA Directive/Handbook 6500. The contract type for this procurement is (Firm Fixed) and the milestone schedule will be accomplished and documented in the Electronic Contract Management System (eCMS). Given the current market environment and shortages, the Contracting Officer determines the price to be fair and reasonable. Cost Market Research Findings: A source sought (36C25520Q0298) was published to bet.sam.gov (contract Opportunity) on March 28, 2020. An additional source sought (36C25520Q0321) was published to bet.sam.gov (contract Opportunity) on April 11, 2020. The published sources sought were seeking companies that could provide Personal Protective Equipment (PPE) against viral contamination, specifically COVID-19. There were numerous vendors that responded to the sources sought. Among the vendors that responded there were numerous SDVOSB , VOSB s and other small business concerns. Although numerous vendors responded in a large range of business concerns, a decision will be made based on product acceptability, fair and reasonable pricing and delivery time. Other pertinent information: On March 11, 2020, the World Health Organization (WHO) declared the COVID-19 outbreak a global pandemic, and on March 13, 2020, the United States issued a Presidential Proclamation declaring the COVID-19 outbreak to be a national emergency. Additionally, all fifty states and the District of Columbia have declared emergencies due to COVID-19. Because COVID-19 is an emerging disease, and there are no vaccines or approved treatments, it is prudent to have adequate flexibility to address this public health emergency. COVID-19 has caused national shortages of medical supplies for the medical staff for the VAMC s. This product is on manufacturing backorder and constrained nationwide for order fulfillment. There are numerous national buys being conducted by Program Contracting Activity Central (PCAC) to bolster the VA s national stock, but those deliveries are weeks away. The Department of Veterans Affairs (VA), VA Heartland Network 15, Contracting Office, has a requirement to provide medical related material and services to various locations across the VISN 15 facilities area of responsibility during this public health emergency and response effort. NCO 15 anticipates receiving requests to procure mission necessary materials and services from within the VISN 15 demographic. Any delay in providing critical medical supplies, services and equipment could cause irreparable harm and put our Veterans and American citizens at an increased risk of transmission and exposure. On April 16, 2020, The Department of Veterans Affairs (VA) Contracting Activities, approved justification and approval based on unusual and compelling urgency for the execution of contract actions required in response to immediate VA requirements for Personal Protective Equipment (PPE) in support of national defense and the national emergency COVID-19. This class justification expires on 15 July 2020, or until the current pandemic is over and the state of emergency is lifted, whichever occurs first. The class justification is for Personal Protective Equipment (PPE) in support of the VA in meeting the PPE needs. The requested Level I Ear loop Masks are an approved product under the approved class justification. Speed Box, LLC can provide the emergency need of Level I Ear loop Masks in a timely manner (7 to 10 days) and at a fair and reasonable cost (.55 cents each). Speed Box, LLC is a Service-Disabled Veteran Owned Small Business according to beta.sam.gov., vetbiz.gov. and Contractor Responsibility Assessment report (FedDataCheck). Recommendations: Based on the above market research, I recommend that this requirement be a Sole Source award to Speed Box, LLC a Service- Disabled Veteran Owned Small Business, in accordance 41 U.S.C. � 3304(a)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-2 entitled, Unusual and Compelling Urgency. . The CO will search the VIP database by applicable North American Industry Classification System (NAICS) codes to determine if two or more verified service-disabled veteran-owned small businesses (SDVOSBs) and veteran-owned small businesses (VOSBs), in the appropriate NAICS code, are listed as verified in the VIP database. The CO will determine if identified SDVOSBs or VOSBs are capable of performing the work and likely to submit an offer/quote at a fair and reasonable price that offers best value to the Government. If so, the CO shall set-aside the requirement in the contracting order of priority (see 819.7005 and 819.7006).
