- The U.S. Nuclear Regulatory Commission (NRC) proposes to enter into a non-competitive contract with ICF Incorporated, LLC (ICF) for the project entitled, �Final Rule - Emergency Preparedness Small Modular Reactor and Other New Technology Rulemaking and Guidance�.� The statutory authority permitting Other Than Full and Open Competition is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1 (b)(1), which provides for limiting competition in those situations where the services are available from only one responsible source and no other type of services will satisfy NRC�s requirements.� The designated North American Industry Classification System (NAICS) Code is 541690, Other Scientific and Technical Consulting Services, with a size standard of $16.5millions.� The anticipated period of performance is 36 months. A sole source contract with ICF is required to meet NRC organization�s needs due to the contractor�s extensive prior involvement over the past three years in this rulemaking, and unique knowledge and qualifications to provide the contract tasking based on their prior involvement.� Since June 2017, the NRC has been working, with the assistance of ICF personnel, to develop a rule that implements a new regulatory framework for emergency preparedness (EP) for small modular reactors (SMRs) and other new technologies (ONTs). �The proposed rule is currently out for public comment and ICF is assisting the NRC with binning and reviewing the comments as they are submitted to the NRC.� The objective of this procurement is to obtain technical assistance for the NRC to support completion of the draft final EP/SMR & ONT rulemaking and guidance.� The contractor shall assist in the organization, review, and adjudication of public comments received during the public comment period.� The contractor shall assist in revising the proposed rule based on the public comments and developing the final rule.� Additionally, shall support the finalization of the draft guidance and other supporting documents (e.g.:�regulatory analysis, OMB supporting statements, inspection procedures, etc.).� The contractor shall utilize knowledge about the history and development of the proposed rulemaking to effectively support the NRC staff.� Knowledge related to the binning of the public comments and the early assessment of the comments is necessary to ensure a consistent and efficient approach to the final rule regulatory requirements and supporting guidance. �In addition, the contractor shall support any related public meetings and Advisory Committee on Reactor Safeguards meetings with presentations, responding to questions, and taking meeting notes during the final rule phase. To accomplish the above stated objectives for this project, the contractor shall: be knowledgeable in the NRC rulemaking process in developing a draft final rule.� This includes familiarity with the preparation and publishing of final rules, and other associated NRC rulemaking actions, such as supplemental proposed rules, and the generation of supporting documents to be included in the rulemaking package (e.g., draft regulatory guides, regulatory analysis, etc.). apply experience gained from the development of other rulemakings, utilize applicable Interim Staff Guidance, and experience from developing other public comment summary and responses to assist in this rulemaking.
