Description

The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Bruker Nano, Inc. DBA Bruker Nano Surfaces Division (""Bruker"") to purchase EBSD Detector + TKD Camera Upgrade with Installation under Other than Full and Open Competition by the authority of FAR subpart 13.106(1)(b)(1) Soliciting from a Single Source. NIST already operates a ThermoFisher (FEI) Apreo SEM equipped with Bruker xFlash EDS detectors.� NIST has an immediate need to acquire, and have installed, the compatible components necessary to enhance the capabilities of the existing Bruker EDS system.� Bruker Nano, Inc is the only authorized seller for the required Bruker eFlashHD camera subsystem. �Bruker Nano, Inc. does not authorize any third-party vendors for the resale or installation of integrating an EBSD camera into the existing Bruker EDS system currently installed on the ThermoFisher (FEI) APREO SEM at NIST. �The associated Bruker ESPRIT software is owned and licensed by Bruker for use with Bruker microanalysis electron microscope accessories.� It is the only control software that works with the existing Bruker equipment. Due to the proprietary nature and need for 100% compatibility with the existing EDS system, only Bruker Nano, Inc. DBA Bruker Nano Surfaces Division (""Bruker"") can fulfill the Government�s requirement.� The North American Industry Classification System (NAICS) code for this acquisition is under 333314- Optical Instrument and Lens Manufacturing. No solicitation package will be issued. This notice of intent is not a Request for Quotation (RFQ) nor is it a request for competition; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 4:00PM (EST) on July 7, 2020. Inquiries will only be accepted via email to Harry.Brubaker@NIST.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
