- The Naval Air Systems Command (NAVAIR) issued bilateral Delivery Order N00019-20-F-0512, under and pursuant to the provisions of N00019-16-G-0001, to The Boeing Company, 6200 J.S. McDonnell Blvd., St. Louis, MO 63166-0516, for the procurement of supplies and services in accordance with: Engineering Change Proposal (ECP) 6344C2 ""AN/APG-79 5th and 6th Receiver Channel wiring and Weapons Replaceable Assemblies (WRA)s - Updated For Production Incorporation and Expanded Retrofit Effectivity;"" ECP 6346R2C1 ""Active Electronically Scanned Array (AESA) Waveform Generator Update - Updated For Production Incorporation and Expanded Retrofit Effectivity;"" and ECP 6381C2 ""AN/APG-79(V) AESA Radar General Purpose Processor 3 (GPP3) Upgade - Updated For Production Incorporation and Expanded Retrofit Effectivity."" This acquisition was conducted on a sole-source basis under statutory authority of Title 10, U.S.C. Section 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, ""Only one responsible source and no other supplies or services will satisfy agency requirements."" A determination by the Government not to compete this effort is solely within the discretion of the Government. This effort is covered under the Class Justification and Approval (CJ&A) number 15-24597, dated 17 January 2018, attached. In accordance with FAR part 16.202-2(c), it was determined a firm-fixed-price (FFP) contract was suitable for acquiring supplies or services on the basis of resonably definite functional or detailed specifications when the contracting officer can establish fair and reasonable prices at the outset, such as when cost or pricing information permits realistic estimates of the probable costs of performance.
