This procurement is for new OEM medical supplies, medical equipment and/or Services Contracts for Maintenance of Medical Equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Contractor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or Services Contracts for Maintenance of Medical Equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or Services Contracts for Maintenance of Medical Equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Contractor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA Medical facility upon discovery of such items. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. All responses from responsible sources will be fully considered. Any prospective contractor must be registered in the System for Award Management (SAM) in order to be eligible for award. All qualified candidates will be verified in Vendor Information Pages (VIP) in order to be eligible for award. Required set-aside is strictly enforced. If you have not conducted business with the Tennessee Valley Healthcare System located in Nashville, Tennessee, you will be required to complete Vendor/Payment Forms to be entered into the local systems in order to be eligible for award. All interested parties shall submit clear and convincing documentation demonstrating their capabilities to satisfy the requirements listed above to Contracting Specialist, Cynthia Machuca at cynthia.machuca@va.gov.
