- Subject: Notice of Intent to Sole Source Procurement Office: U.S. Environmental Protection Agency, Headquarters Acquisition Division 1200 Pennsylvania Avenue NW, Washington DC 20460 In accordance with FAR 13.106-1(b), the U.S. Environmental Protection Agency (EPA), Headquarters Acquisition Division (HQAD) intends to award a Sole Source Firm Fixed-Price Purchase Order to procure a microwave digestive system from Anton Paar USA, Inc. of Ashland, VA. EPA has identified Anton Paar as the only contractor able to meet the requirements of this procurement. The anticipated contract type is firm-fixed-price (FFP). The government will only solicit a single source, which is Anton Paar USA, Inc. (DUNS: 157296476). The contract action is for the purchase of a microwave digestive system which is estimated to cost approximately $61,000. The U.S. Environmental Protection Agency (EPA)/Office of Enforcement and Compliance Assurance (OECA)/Office of Criminal Enforcement, Forensics, and Training (OCEFT)/Office of National Enforcement Investigations Center (NEIC)/Laboratory Branch Intends to procure on a sole source basis a microwave digestion and reaction system for the efficient and effective preparation of environmental samples for accurate analysis. Market research was conducted, and pricing and product information obtained from multiple manufacturers of microwave digestion systems. The Anton Paar Multiwave 5000 is a versatile and modular microwave reaction platform system that can be used with various rotor types for fast and complete digestion and extraction of organic and inorganic samples under high pressure and temperatures. It is a rotor-based system with the widest range of rotor types and special applications available. Anton Paar GmbH is the sole manufacturer of the Multi wave 5000 microwave reaction system, and Anton Paar USA, Inc., is the sole provider in the United States of the Multiwave 5000 and all accessories identified. Market research supports that Anton Paar Multiwave 5000: (1) was the only system available with all the required capabilities, vessel and rotor combinations to accommodate the required sample type and acid dosing volume; (2) provide the most significant cost savings when compared to other systems; and (3) prices are determined to be fair and reasonable when compared to other manufacturers and represents the best value to the Government. The North American Industry Classification System (NAICS) code is 423490 - Other Professional Equipment and Supplies Merchant Wholesalers, with a small business size standard of 500 employees. The Government is continually seeking qualified vendors in obtaining a source list of interested vendors. However, Anton Paar USA, Inc. is the only vendor that meets the requirements outlined in the procurement request package. NO SOLICITATION IS AVAILABLE. This notice of intent to award is not a request for competitive quotations. Interested concerns capable of providing the service as described in this notice may submit a Capability Statement outlining their capabilities. Information received will be evaluated for the purpose of determining whether to conduct a competitive procurement. Capability Statements must be received within the time set forth in this announcement to be considered by the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. A determination to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Type of Company (i.e., small business, 8(a), woman owned, HUBZone, veteran owned. etc.) as validated in System for Award Management (SAM). Capability Statement Responses to this posting must be in writing and provide clear and convincing evidence that competition would be advantageous to the Government. A determination not to compete the proposed purchase order based upon the responses to this notice is solely within the discretion of the Government.
