- John Day Control Room Fire Protection Upgrades Engineering During Construction (EDC) services Notice of Intent to Sole Source This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) Subpart 5.2 �Synopses of Proposed Contract Actions.� The Army Corps of Engineers intends to negotiate the sole-source award of a new contract with HDR Engineering Inc.� The purpose of this task order is to provide Engineering During Construction (EDC) services.� Work effort will consist of construction phase services to be performed while the construction contractor performs on the project entitled, Control Room Fire Protection, at the John Day Dam.� Pursuant to 10 U.S.C. � 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1 and the Defense Federal Acquisition Regulation (DFARS) 206.302-1, only one responsible source and no other vendor will satisfy agency requirements. HDR Engineering Inc. is the designer of record (DOR) for the John Day Control Room Fire Protection project, developing the design for that project under task order no. W9127N-17-F-0018.� If the Government were to award an EDC contract to a firm that is not the DOR, the Government would incur costs that substantially duplicate those incurred under task order no. W9127N-17-F-0018.� It would be expected that this firm would need to go back and check the Plans & Specifications (P&S) against its own calculations and/or redo at least part of the P&S since it is now responsible for the success of the design.� The set of plans/drawings not only would need to be checked and reviewed for quality assurance by the new firm, but also would require an additional Professional Stamp approving those drawing. This will not happen until the new engineering professional is entirely confident in the design and the calculations. This process would result in significant duplication of effort and cost.� Additionally, it is not expected that these costs would be recovered through competition, as the selection of a contractor for A/E requirements does not consider price, other than reasonableness, per FAR Subpart 36.6. A SOLICITATION WILL NOT BE POSTED THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement to the contracting officer before the notice end date.� If no affirmative written responses are received by 2:00 PM Pacific time on 16 September 2020, the Contracting Officer will proceed with the sole source action. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.� Electronic responses and questions shall be submitted via email to BOTH POCs listed, below.� The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
