- Abstract This announcement invites entities that intend to propose as prime offerors on the Federal Aviation Administration (FAA) Enterprise Network Services (FENS) to identify any actual or potential organizational conflicts of interest (OCIs) related to the FENS procurement. In addition, the FAA requests that intended prime offerors to the FENS SIR provide the FAA CO with a confidential list of their planned solution delivery team members. AMS 3.1.7 Organizational Conflicts of Interest provides that: The policy of the FAA is to avoid awarding contracts to contractors who have unacceptable organizational conflicts of interest. The FAA will resolve organizational conflict of interest issues on a case-by-case basis; and when necessary to further the interests of the agency, will waive or mitigate the conflict at its discretion. Under AMS T3.1.7, an OCI means that, because of existing or planned activities, an offeror or contractor is unable or potentially unable to render impartial assistance to the agency, or has an unfair competitive advantage, or the offeror or contractor's objectivity is or might be impaired. AMS T3.1.7 encourages resolution of OCI issues early in the acquisition process, if possible. Accordingly, the FAA requests that intended FENS prime offerors submit all information regarding potential or actual OCI matters pertaining to the FENS Screening Information Request (SIR). Response to this request is optional. The intent of the FAA is to: (1) Identify and evaluate potential OCIs early in the acquisition process; and (2) to allow sufficient time before screening and selection to avoid, neutralize, or mitigate potential conflicts, if possible. The scope of this request to identify actual and potential OCIs applies to prospective primes and their planned subcontractors, teaming partners, and other members of their solution delivery team. The FAA requests that each prime compile and respond on behalf of all of its solution delivery team members. The FAA also requests that each prospective prime identify its planned solution delivery team and provide the FAA CO with a list thereof. The FAA will not release that information publically and its intended use is to update FAA internal documentation related to non-disclosure of information and conflicts of interest pertaining to the screening and selection teams of the FAA. Response to this announcement is not a pre-condition to proposing to the FENS SIR. This announcement does not obviate any need to comply with all SIR instructions if a proposal response is made to the FENS SIR. Please submit all questions to the Contracting Officer, Mr. Dennis Scanlon via 9-AJW-FENSinfo@faa.gov and responses to this announcement to the same email address no later than September 22, 2020. The FAA will accept supplemental responses, including new OCI matters, if an intended prime obtains additional information.
