Description
General The Bureau of International Narcotics and Law Enforcement Affairs (INL) requires the services of an international consulting organization to provide four (4) courses that will be taught in three (3) events per course, making a total of twelve (12) events, customized Asset Forfeiture trainings for up to 300 officials of the Government of Panama. These will be interagency training courses with the participation of� investigators from the National Police (DIJ) and the Institute of Legal Medicine and Forensic Science (IMELCF), prosecutors from the Public Ministry, judges from the Judiciary Branch, and officials from the Asset Management Office from the Ministry of Economy and Finance (MEF).���� 2. Background The U.S. Department of State is supporting the GOP as part of an on-going effort to dismantle transnational criminal organizations through asset forfeiture of properties which origin or use is related to illicit activities. 3. Scope of Services The scope of services for this project is as follows, as implemented by a consultant or trainer of the Contractor: A. Introduction/Background International treaties signed by Panama provides that the States will take measures against transnational criminal organizations, among them, asset forfeiture of properties with origin or use related to illicit activities. This responsibility is contemplated in the Vienna Convention against Drugs Illicit Traffic in Narcotic Drugs and Psychotropic Substances (Act 20 from 1993), Palermo Convention against Transnational Organized Crimes (Act 23 from 2004), United Nations Convention against Corruption (Act 15 from 2005) and the GAFI�s Recommendation� Number 4. These international laws encourage the countries to seize properties with illicit origin or use, with no criminal conviction, to prevent that criminal organizations take advantage. INL supports the GoP for the development of interagency officials� skills related to the Asset Forfeiture regime, to investigate, confiscate and use funds that are obtained from illicit activities, in prevention, security and justice programs. B. Objectives The successful bidder (Contractor) will train participants on Asset Forfeiture, as well as on property investigation techniques, provisional measures, the process of the Asset Forfeiture with respect to the jurisdiction and property management regime. The Contractor will train participants on the best practices to be applied in the different phases when implementing an Asset Forfeiture program. C. Scope of Work The Contractor will provide training including interactive lectures, group exercises, and a final evaluation of the participants. D. Conditions of Training The trainings will be of at least sixteen hours each week.� The training courses and the materials provided to the participants, must be delivered in Spanish.��� 4. Training Venues The contractor shall provide a hotel conference room or training facility in Panama City, Santiago, David and Azuero Region (Herrera and Los Santos), with two (2) heavy snacks per day and/or restaurants no more distant than 100 meters around. The training rooms should have the necessary equipment and implements for the development of trainings. Additionally, the Contractor will include two heavy coffee breaks daily to the participants and parking services for each participant during training days. The trainings have been scheduled in the following tentative dates: Panama City-three training courses: November 2020, December 2020, January 2021 Santiago-three training courses: October 2020, February 2021, March 2021 David � three training courses: April 2021, June 2021, August 2021 Azuero-three training courses: May 2021, July 2021, September 2021 5. Requirements 5. 1. Contractor shall sign a Non-Disclosure agreement.� ����������� 5.2.� Contractor shall provide to all the participants printed handouts. 5.3. Contractor must provide all participants electronic copies of presentation material, within seven (7) days of the completion of the training. 5.4.� Contractor must provide certificates of completion of training, to participants. 6. Qualifications 6.1.� Consultant must have at least five consecutive years of relevant, comprehensive professional experience in designing and delivering local and international training on Asset Forfeiture. 6.2.� Consultant shall be fluent in both written and spoken Spanish and English languages. 6.3.� Consultant should have been a former prosecutor, judge or asset manager. 6.4.� Consultant must possess at least training certification or diploma on Asset Forfeiture. 6.5.� Consultant will have wide experience as instructor on Asset Forfeiture trainings, addressed to government officials. 6.6.� Consultant shall perform all activities needed to prepare for and conduct the training including reaching out the place where the training course will be taking place. 6.7.� The Consultant will allow the U.S. Embassy to review the content of the slide presentations, at least two weeks before the training, and will consider mutually agreeable edits, in advance. Deliverables: ����� Consultant must submit the following: One or more Presentation(s) on property investigations on Asset Forfeiture. One or more Presentation (s) of precautionary measures cases. One or more Presentation (s) of Asset Forfeiture prosecution case processes. One or more Presentation (s) of asset management cases, including the use of funds coming from illicit activities in the prevention, security and justice programs. Certificates issued for participants who have attended 100% of the training courses. Evaluation of the participants knowledge at the conclusion of the trainings.
