- GENERAL INFORMATION FOLLOWED BY A TENTATIVE STATEMENT OF WORK SOURCES SOUGHT NOTICE: This is not a solicitation but rather a Request for Information (RFI/Sources Sought) for market research purposes only. Veterans Health Affairs, Network Contracting Office 4, is issuing this Sources Sought in order to identify capable firms and obtain information for planning purposes only. Veterans Health Affairs, Network Contracting Office 4, is issuing this Sources Sought in order to identify capable firms for Shredding Services for the Lebanon VAMC. Responses shall be submitted by 11:59pm (EST) September 25th, 2020. Responses shall be submitted via email to william.schlobohm2@va.gov . All SDVOSB and VOSB firms that respond shall include proof of CVE certification via www.vip.vetbiz.gov. All small business firms that respond shall include proof of small business status via their Representations and Certifications in accordance with (FAR 4.1102 Policy). While SDVOSB/VOSB contractors are preferred, all capable contractors are welcome to respond to this sources sought notice for market research purposes. All respondents shall include as part of their response a brief capability statement that covers the information in the following tentative statement of work, as well as answers to the below three (3) questions. The results of this market research will assist in the development of (1) the requirement, and (2) the acquisition strategy (e.g., socioeconomic set-aside, full and open competition, etc.). VA assumes no responsibility for any costs incurred associated with the preparation of responses. Suggested NAICS: 561990 (All Other Support Services) Suggested PSC: R614 (Support-Administrative Paper Shredding) Open to suggestions from the market as to a more proper NAICS and/or PSC, as well as any potential GSA/FSS Schedule SIN categories. In addition to the information requested above, please include answers to the below 3 questions as part of your response to this Sources Sought: 1. Identify any other companies owned (wholly or in-part) by the owners of this business who provide goods or services under the same or a related NAICS codes. 2. Identify any other companies owned (wholly or in-part) by the owners of this business who provide goods or services that are registered under the same or a related NAICS code with the Center for Veterans Enterprise (CVE); Provide the certification type (SDVOSB/VOSB), Federal Identification Number, and state of incorporation for each. 3. Do you plan on responding to a solicitation for this requirement with a Joint Venture utilizing multiple owned companies as majority or non-majority owner? SAMPLE / TENTATIVE STATEMENT OF WORK (BELOW) PERFORMANCE WORK STATEMENT Shredding Services SECTION 1 - INTRODUCTION 1.1 Lebanon Veterans Affairs Medical Center (LVAMC), located at 1700 South Lincoln Avenue, Lebanon PA 17042, is looking to for qualified, experienced and dependable companies/contractors that can provide on-site shredding of confidential material. Contractor must be able to provide a truck/mobile unit that is specifically designed to shred sensitive/confidential documents and products through a cross-cut shredding systems. Contractor will provide an On-Site Service Slip, Accountability Spreadsheet/Checklist and a Certificate of Destruction for shredding service performed. Shredding services will be done on a weekly basis at the main medical center and will be divided into two types of weekly pick up; full service and half service as shown on Chart 6.4, Table F below. 1.2 In addition, Contractor must be able to provide on-site shredding of confidential material at the (4) VA Community Clinics (VACC s) in the VA VISN 4 Region/South Central Pennsylvania and any additional VACC s that may be activated within the contract period. The VACC s are located in Cumberland, York, Lancaster and Berks County. The Contractor will provide an On-Site Service Slip, Accountability Spreadsheet/Checklist and a Certificate of Destruction for shredding service performed. VACC locations will be provided for Contractor to view and are scheduled for service every month. Please see chart 6.2, Table D and Chart 6.3, Table E below. SECTION 2 - SCOPE OF WORK 2.1 Contractor shall provide all labor, personnel, equipment, supplies, secured vehicles, material, supervision and other related services necessary to provide commercial document destruction for LVAMC and VACC s within the Department of Veterans Affairs. 2.2 Contractor shall provide on-site shredding and removal of confidential material at Lebanon VA Medical Center. Weekly service day will be determined after award of contract. 2.3 Contractor shall provide on-site shredding and removal of confidential material at (4) VA Community Clinics. Monthly service day will be determined after award of contract. Contractor employees will not reveal, divulge, or disseminate any oral or written information obtained as a result of execution of this shredding contract or performance of work hereunder. All sensitive documents/material, regardless of classification, is protected from unauthorized viewing and is destroyed properly by shredding and or pulverizing. Contractor shall allow for on-site vehicle inspection of shredded media for compliance of VA Policy. 2.6 Contractor shall provide a shredding service for all purged/boxed sensitive material at no extra cost to the VA. Records Manager and COR will schedule and coordinate the destruction with incumbent Contractor (all parties agree on a date and time). Location of bins/receptacles and contact information will be reviewed and discussed during kick off meeting. Forms/spreadsheets etc. will be distributed at meeting. SECTION 3 - PERIOD OF PERFORMANCE 3.1 Establish a 12-month contract/base period with (4) one-year options/extensions with same terms and conditions. Any successive option/extension must have written approval of both the LVAMC contracting department and contractor no later than 30 days prior to expiration of previous 12-month period. 3.1.1 Base Year: 01/01/2021-12/31/2021 Option Year One (1): 01/01/2022-12/31/2022 Option Year Two (2): 01/01/2023-12/31/2023 Option Year Three (3): 01/01/2024-12/31/2024 Option Year Four (4): 01/01/2025-12/31/2025 3.2 Phase-out Plan: Contractor shall have/provide a phase out plan. This plan shall describe the Contractor s methods and procedures to ensure smooth and uninterrupted service at expiration contract date. Contractor shall fully cooperate with the successor Contractor and the Government so as not to interfere with their work or duties. 3.3 Charges/Invoices: Bid/Quote prices must include all charges. Additional fees or surcharges for fuel or other items must not be shown separately. Request for any charges beyond the container rate (Ex: 95 Gallon Tote) will be rejected. No hidden charges allowed. SECTION 4 - CONTRACTOR PERFORMANCE 4.1 Certifications: Awarded contractor must be AAA certified by National Association for Information Destruction (NAID). Failure to keep NAID certification will result in bid rejection/cancellation of contract. 4.1.1 Contractor will destroy all paper products through an acceptable process which renders the confidential material completely unreadable in compliance with NIST (National Institute of Standards and Technology) Special Publications 800-88. A copy of the publication is available at: http://csrc.nist.gov/publications/nistpubs/800-88/NISTSP800-88_rev1.pdf. 4.1.2 Contractor shall protect, safeguard, control, manage, and destroy VA designated confidential documents complying with VA Directive 6371, dated May 2, 2008 (Attachment V and VI). 4.2 Formal Certificate of Destruction: A legal record (Industry Standard) which should include date of destruction, a reference number, method of destruction, identify material destroyed and amount of shredded waste. Amount refers to number of full totes (95 Gallon) used during shredding. A Formal Certificate of Destruction will be issued by contractor each month and filed by the Contracting Officers Representative (COR). Destruction forms should be compliant with NIST and Federal Information Processing Standards FIPS regulations. 4.3 On-Site Service Slip: After each on-site shredding service, the Contractor shall provide a summary, to the Environmental Management Services (EMS) COR, stating the number of bins that were collected at the time of service. The On-Site Service Slip shall be signed by both the Contractor and the EMS COR. 4.4 Accountability Spreadsheet/Checklist: Contractor will provide a spreadsheet/checklist verifying bin locations that have been serviced. The purpose of this spreadsheet/checklist is to provide issue awareness and to prevent missed bins. 4.5 Quality of Work: On-site shredding will be conducted each week at the LVAMC and on-site shredding will be conducted once a month at the VACC s. Service techs will collect confidential material from locked consoles, bins and totes. The confidential material gets placed into 95-gallon totes; the mobile tote, when full, is transported to shredding truck, tote is mechanically lifted and emptied, and confidential/sensitive material is destroyed (pierce and tear) using a cross-cut shredder which produces particles 1x5 millimeters in size. 4.6 Contingency Plan: Contractor must provide notice in writing of their contingency plan in the event of equipment failure, truck break down, inclement weather conditions or unplanned events. Contractor must provide a written notice 24 hours prior to any planned event (i.e. Observed Holidays) with their contingency plan. Contractor shall go over service calendar to ensure that all Observed Holidays have a contingency plan if it falls on a service day. Neither planned nor unplanned events should place the burden on the LVAMC for accommodating full bins. 4.6.1 Mandated Contingency Plan: (Table A) ISSUE CONTRACTOR RESOLUTION SHREDDING TRUCK IS UNAVAILABLE FOR ON SITE SHREDDING AT THE LEBANON VA FACILITY CONTRACTOR PERSONNEL SHALL SERVICE LEBANON VA FACILITY AS NORMAL AND TRANSPORT ALL LOCKED 95 GALLON TOTES TO SECURED STAGING AREA LOCATED IN BUILDING 19, ROOM #142 CONFIDENTIAL MATERIAL IS SHREDDED AS SOON AS POSSIBLE AN ON-SITE SERVICE SLIP IS PROVIDED WHEN ALL MATERIAL IS DESTROYED ON SITE SHREDDING TRUCK IS UNAVAILABLE FOR ON SITE SHREDDING AT THE VACC S CONTRACTOR SHALL PROVIDE A (95) GALLON TOTE FOR EACH OF THE VACC LOCATIONS AFFECTED TO UTILIZE FOR ANY OVERFLOWS. CONFIDENTIAL MATERIAL IS SHREDDED AS SOON AS POSSIBLE AN ON-SITE SERVICE SLIP IS PROVIDED WHEN ALL MATERIAL IS DESTROYED ON SITE VENDOR MISSED SHRED BINS AT ANY LOCATION CONTRACTOR SHALL COME BACK TO SERVICE THE BIN(S) WITHIN THE SAME WEEK 4.7 Phase-In Plan/Installation: upon the award of this LVAMC shredding contract, the Contractor shall be responsible for placing, providing and positioning all consoles, slim line containers and 95-gallon totes in designated/required locations throughout the Medical Center and at all the VACC s. The equipment and installation will be provided at no additional charge. The amount of equipment needed and set locations will be provided in the scope of Worktables A & B Receptables Needed. 4.8 Furnishings: All accessed areas must be returned to their original state. 4.9 Contractor Supplies, Equipment and Keys: Contractor must furnish all material, equipment and supplies for full-service shredding contract. Contractor shall be responsible for placing and installing consoles, bins and totes in the required locations. All receptacles shall be of excellent quality and shall be free of defects that would diminish the appearance of collection containers or render containers structurally or operationally unsound. Contractor must provide suitable, locked covered receptacles and long cloth bags/box insert. Three sets of keys will be needed; one set for Privacy Officer, one set for VA Police and one set for the EMS COR. All equipment, furniture, items, etcetera moved during services are returned to original location 4.9.1 All supplies, equipment and keys are supplied at no cost to the government/Lebanon VA Medical Center. The locations for receptacles are subject to change by the LVAMC and VACC s. The COR shall notify the contractor, in writing, of location changes and/or adding of additional receptacles. 4.10 Contractor must furnish all consoles, cloth bags/box inserts, slim line containers, locked totes and keys. Rendered shredding services at LVAMC will be provided on a weekly basis with a starting time between 8:00a.m. and an ending time not to go past 4:30p.m. 4.11.1 Contractor is required to pick up on a weekly basis, however, certain areas are only to be service bi-weekly. Information is provided on Table D. 4.12 Monthly Service Parameters: No work shall be performed prior to receipt of a written Purchase Order, Contract No., Solicitation No. and the filing and approval of a Certificate of Insurance with Lebanon VA contracting department. Rendered shredding services at VACC s will be provided on a monthly basis with a starting time between 8:00a.m. and 10:00a.m. and an ending time not to go past 4:30p.m. 4.12.1 Recognized Holidays: The contractor shall not schedule service on the following Federal Holidays: New Year s Day / Martin Luther King Jr. Birthday / President s Day / Memorial Day / Independence Day / Labor Day / Columbus Day / Veterans Day / Thanksgiving Day / Christmas Day. 4.12.2 When recognized Federal Holiday conflicts with a scheduled pick up,Contractor will adjust their schedule to pick up on the next available business day. Contractor will provide the COR with a calendar with all the dates of pick up, to include days of pick up in lieu of holiday. 4.13 Performance: Contractor s personnel must be capable of performing at an effective level in accordance with specifications and industry standards. All work shall be performed in a workmanlike manner and in compliance with all federal, state and local laws and codes. All workers shall be required to provide service with a minimum of prompting or direction from the EMS staff. Each service tech is to turn in their accountability spreadsheet/checklist and On-Site Service Slip each week. NAID certified contractor shall provide on-site shredding (pierce and tear) and removal of confidential material at the LVAMC and (4) VACC s. Final destruction/pulped will take place during recycling process. VA Directive # 6371(b) Final Destruction: The process through which temporary paper records are pulped, macerated, shredded or pierce and tear to a degree that ensures sensitive material are not readable or constructible to any degree. Awarded contractor must be AAA certified by NAID. Failure to keep NAID certification will result in bid rejection/cancellation of contract. Ensure that all contents of totes remain inside totes during transport to shredding vehicle or picked up immediately when sensitive material mistakenly falls out of totes. No totes or sensitive material is left unattended and one person is present during shredding operations at the shredding hopper/vehicle to ensure that no sensitive material mistakenly falls out of tote or is blown away by the wind. If sensitive material falls out of tote and/or hopper technician will retrieve sensitive material immediately and shred accordingly. SECTION 5 CONTRACTOR PERSONEL 5.1 Personnel: Contractor shall have in their employ and/or under their control, enough qualified and competent personnel to perform shredding services in accordance with NAID regulations. An extensive background check is required for all contractor drivers and service techs assigned to provide shredding services at the LVAMC and VACC s. Contractor is to provide uniformed personnel, trained, licensed and bonded staff to perform full shredding service. Documentation of NACI background investigations will be provided to the COR on all contract employees. In addition, designated contract employees will be fingerprinted by the Personal Identity Verification (PIV) Office at the LVAMC. Service Technicians: Shall report to the COR for coordination of badging and fingerprinting. No Service Technician will be allowed to work on this contract without providing proof of NACI security check performed by the VSC Security through the Lebanon VA Medical Center. All Service Technicians shall display badges while performing requirements of contract; badges shall be worn above the waist at all time while on campus and at VACC s. All Service Techicians shall check-in with EMS prior to starting and after all work/shredding service has been completed. Supervision: In the beginning of contract and/or when a new contract employee starts the Contractor shall provide onsite supervision to inspect work, assure all safety and security precautions are met and expectations are fulfilled. Conduct: The Contractor is always fully responsible for the conduct of his/her employees while performing under this shredding contract. The Contractor shall not allow any employee to perform work under the influence of alcohol, drugs, or any other incapacitating agent. VA Police have the right to deny entry to the Medical Center or remove from the facility any contractor employee for misconduct that endangers the health and/or safety of people at the LVAMC and VACC s. Smoke Free Facility: The VA Medical Center is a non-smoking facility, at no time shall the Contractor or its employees smoke on VA grounds. Non-Disclosure of Sensitive Information: Contractor staff/employees involved with this shredding contract will have access to some privileged and confidential material of the US Government. These printed documents are for internal use only and remain the sole property of the LVAMC and VACC s. Some of the materials are protected by Privacy Act of 1974 and Title 38. Unauthorized disclosure of Privacy Act or Title 38 covered materials, by any contractor or subcontracted staff, is a criminal offense. The Contractor is responsible for actions of contract employees. Inspections: Representatives of the Government (COR, VA Police, Safety Officer, Privacy Officer, Information Security Office, Records Manager and Associate Director) shall have the right to inspect the contractor s and/or subcontractor s facilities, vehicles, equipment and operations provided for the performance of work/shredding services under this agreement/contract. Quality Assurance: Government officials (COR, VA Police, etc.) will receive and investigate complaints from various customers located at LVAMC and VACC s. All information received will be provided verbally and/or in writing to the contractor for appropriate action. Substandard Work: Contractor will correct or cause to have corrected any substandard work/discrepancies as requested by the COR and/or designee. Reassignments: The Contractor shall utilize, on this shredding contract, only workers that are skilled in the tasks to which they are assigned. EMS retain the right to require the reassignment of an employee or employees as they may deem necessary. Reasons for this request may be, but are not limited to poor work performance, incompetence, carelessness, disruptive or otherwise objectionable behavior. The request for reassignment is in no way a call for dismissal. It is just a request for the individual to be reassigned away from the LVAMC and VACC s. Uniforms/Identification: All company workers while on duty at the LVAMC or VACC s shall be identified by uniform shirt, blouse or smock indicating the company name or logo in print large enough to be easily read. In addition, all company staff assigned to provide shredding services at the LVAMC or VACC s shall be easily contacted by the use of a cell phone. Occupant Safety: Work shall be done in such a manner so as to create a safe working and walking situation and be of little disruption for all staff, patients and visitors throughout the LVAMC and at all of the VACC s. Engine to shredding truck is to be turned off/shut down during on-site shredding. Truck cab should always be locked when unoccupied. Safety Plan: Contractor shall provide a safety plan and copy of safety manual prior to starting any work/service. Occupational Safety and Health Administration (OSHA) requires all companies and corporations to have a printed safety manual. Parking of Shredding Truck: It is the responsibility of the Contractor s personnel to park in the appropriate designated parking areas. Parking information shall be coordinated with the COR. Cab shall remain locked when unoccupied and engine turned off. (PENNDOT Regulation). Traffic Laws: The contractor and its employees shall comply with all VA traffic laws. LVAMC does not validate or make reimbursements for parking violations under any circumstance. Statutory Requirements 6500.6 Appendix C Access to VA Information and VA Information Systems A contractor/subcontractor shall request logical (technical) or physical access to VA information and VA information systems for their employees, subcontractors, and affiliates only to the extent necessary to perform the services specified in the contract, agreement, or task order. All contractors, subcontractors, and third-party servicers and associates working with VA information are subject to the same investigative requirements as those of VA appointees or employees who have access to the same types of information. The level and process of background security investigations for contractors must be in accordance with VA Directive and Handbook 0710, Personnel Suitability and Security Program. The Office for Operations, Security, and Preparedness is responsible for these policies and procedures. VA Information Custodial Language Information made available to the contractor or subcontractor by VA for the performance or administration of this contract or information developed by the contractor/subcontractor in performance or administration of the contract shall be used only for those purposes and shall not be used in any other way without the prior written agreement of the VA. This clause expressly limits the contractor/subcontractor's rights to use data as described in Rights in Data - General, FAR 52.227-14(d) (1). If VA determines that the contractor has violated any of the information confidentiality, privacy, and security provisions of the contract, it shall be sufficient grounds for VA to withhold payment to the contractor or third party or terminate the contract for default or terminate for cause under Federal Acquisition Regulation (FAR) part 12. 7.3 Security Incident Investigation 7.3.1 The term security incident means an event that has, or could have, resulted in unauthorized access to, loss or damage to VA assets, or sensitive information, or an action that breaches VA security procedures.
