Description
The Department of Labor (DOL)/Office of the Senior Procurement Executive (OSPE) intends to award a sole source order to NDT Technologies, Inc. for the Mine Safety and Health Administration. This purchase is for a LMSA-250S New Generation Sensor Head. The North American Industry Classification System (NAICS) code for this requirement is 334515 - Instrument Manufacturing for Measuring and Testing Electricity and Electrical Signals with the size standard of 750. The U.S. Department of Labor, Mine Safety and Health Administration (MSHA) is responsible for enforcing health standards promulgated under the authority of Section 103 (a) of the Federal Mine Safety and Health Act� of 1977. �The Mine Safety and Health Administration�s (MSHA) MESD (Mine Electrical Systems Division) group provides technical assistance to MSHA enforcement personnel at Mines across the United States. Hoist and elevator ropes are examined at the mine site as requested to determine if the requirements of Title 30 CFR are being met. This testing equipment is necessary to conduct the necessary fieldwork to meet this objective. MESD provides the capability to electro-magnetically examine steel wire ropes in the mining industry to ensure the safety of miners. This capability has been maintained within MSHA Technical Support since the mid 1980�s. Since this time MSHA periodically upgraded the signal capture and processing of the equipment as well as purchasing new inspection equipment. NDT Technologies Inc. was the vendor selected in the 1980�s to adequately provide for and service MSHA�s testing equipment. The equipment is durable and very reliable and NDT Technologies is the only manufacturer and reseller of this type of equipment in the United States. The test heads originally purchased are still in use today. This upgrade will complete a replacement of the largest test head, which is showing signs of deterioration after over 35 years of use. �This requirement is for one LMA-250S New Generation Sensor Head (for ropes up to 64 mm diameter which includes a rope distance counter wheel assembly, three (3) sets of rope guides, connecting cable (50 ft. long)), operating and maintenance manual and customized carrying case. �The resulting order will be firm fixed price. The statuary authority permitting other than full and open competition is 41 U.S.C 3304(a)(1), as implemented by FAR Part FAR 13.106-l(b)(I)(i) Soliciting from a single source. Interested persons may identify their interest and capability to respond to the requirement by 9:00 a.m.� 09/25/2020. Written responses to this notice shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. All interested sources may submit a quote which will be considered by the agency for future purposes. This notice is not a formal solicitation. This is not considered a Request for Quote (RFQ). No solicitation document is available and telephone requests will not be honored. No contract will be awarded on the basis of information received in response to this notice. Any response to this notice must show clear, compelling, and convincing evidence that competition will be advantageous to the Government. If no affirmative written response is received, the contract will be awarded without further notice. A determination by the Government not to compete the proposed contract on this notice is solely within the discretion of the Government. Information related to the potential availability of other sources that can fulfill this requirement must be received by the Purchasing Agent, Julie Clay at clay.julie @dol.gov.
