Description: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 as supplemented with additional information included in this notice.ï¿½ This announcement constitutes the only solicitation and a separate written solicitation will not be issued.ï¿½ This solicitation number is NICHD-21-006 and is issued as a Request for Quotation (RFQ).ï¿½ The solicitation/contract will include all applicable provisions and clauses in effect through Federal Acquisition Circular 2020-09.ï¿½ The North American Industry Classification (NAICS) Code is 811219 with a size standard of $22m. ï¿½ï¿½However, this solicitation is not set aside for small business.ï¿½ This acquisition is being conducted using Simplified Acquisition Procedures in accordance with FAR Part 13.ï¿½ Eunice Kennedy Shriver National Institute of Child Health and Human Development (NICHD) intend to procure on a sole source basis from Sony Biotechnology Inc. ï¿½ï¿½ 1730 N. 1st Street ï¿½ï¿½ San Jose, CA 95112 97124 ï¿½to provide a Fixed Priced Base Plus Three Options Periods ï¿½Service Agreement/Extended Warranty ï¿½(Base Year period of performance (POP) Dec 1, 2020 ï¿½ Nov 30, 2021, ï¿½1st option period POP Dec 1, 2021 through Nov 30, 2022, the 2nd option period POP, Dec 1, 2022 through Nov 30, 2023 and the 3rd option period POP Dec 1, 2023 to Nov 30, 2024 ) for the following: Sony Cell Sorter, Model SH800SGP, Serial #0307001 ï¿½ Quantity (1) EA Services to include but not limited to: ï¿½ 5-day Coverage ï¿½Monday through Friday (except Sony Biotechnology holidays) This Service Agreement covers the Sony Biotechnology instrument specified by serial number excluding computer workstation, options purchased separately from the instrument, and any third-party items (compressor, vacuum pump) sold at the time of purchase. The Service Agreement covers all labor, travel expenses, telephone support and parts, excluding some consumables. The Service Agreement includes: ï¿½ One (1) Preventative Maintenance Inspection to be performed during the twelve-month period ï¿½ Software revisions that are released during the term of the Service Agreement provided no hardware upgrades are required. ï¿½ Unlimited telephone support for instruments and Sony Biotechnology proprietary software ï¿½ Unlimited on-site service support if it is determined by Sony Biotechnology that on-site support is required Coverage Coverage hours are Monday through Friday from 9:00 AM to 5:00 PM local time, excluding Sony Biotechnology holidays. Response time For on-site support, our goal is for a qualified technician to arrive on-site within 72 hours of dispatch. The extended warranty for the SH800 cell sorter is needed for preventative maintenance and to ensure that any future issues are covered financially and will be repaired efficiently with minimal downtime. This sorter is heavily used by numerous NICHD labs and thus regular upkeep and maintenance is required to ensure that researchers can utilize this sorter for all current and future experiments. Sony Biotechnology Inc. (ï¿½Sonyï¿½) is the sole source provider of maintenance services for its products. Sonyï¿½s SH800SGP instrument/equipment is manufactured solely by Sony. The Equipment should only be repaired and serviced by a qualified Sony technician that is fully trained by Sony personnel. This specialized training is only offered to Sonyï¿½s direct employees. Furthermore, only Sony technicians have access to software updates and genuine Sony parts. ï¿½As the original equipment manufacturer of the Equipment, Sony is the only company capable of providing all required resources to service the Equipment in a complete and professional manner. Due to the sensitive nature of the Equipment, it is imperative that the maintenance provider has access to the latest tools and materials required to keep the Equipment operating at optimum levels. In this case, Sony is the only company that can provide comprehensive maintenance services for the Equipment. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of the 41 U.S.C. 253(c) (1), FAR 6.302.ï¿½ Only one responsible source and no other supplies or services will satisfy agency requirements.ï¿½ The offeror must include a completed copy of the provision of FAR Clause 52.212-3, Offeror Representations and Certifications ï¿½ Commercial Items with its offer.ï¿½ The provisions of FAR Clause 52.212-1 Instructions to Offerors ï¿½ Commercial Items; FAR Clause 52.212-2, Evaluation ï¿½ Commercial Items factors: technical capability to provide all products and service, price and past performance. Technical capability and past performance, when combined, are significantly more important than cost/price; FAR Clause 52.212-4, Contract Terms and Conditions ï¿½ Commercial Items; and FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders ï¿½ Commercial Items ï¿½ Deviation for Simplified Acquisitions applies to this acquisition.ï¿½ Note to Contractor:ï¿½ ï¿½The contractor shall provide a completed copy of FAR 52.204-24, ""Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment"" with their quote in response to this solicitation.ï¿½ The offeror must include their Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size.ï¿½ The clauses are available in full text at http://www.acquisition.gov/far/.ï¿½ Interested vendors capable of furnishing the government with the products and services specified in this synopsis should submit a copy of their quotation to the below address or via email to robinsti@mail.nih.gov.ï¿½ All responsible sources who are certified by Sonyï¿½ Biotechnology Inc (Sony) ï¿½as authorized third-party repair and service vendor may submit a proposal showing their capabilities and past performance from three separate customers (dated within the last 12 months of this notice) repairing this type of equipment/components. The vendors shall provide certification from original equipment manufacturer (OEM), Sony Biotechnology Inc (Sony) that they are authorized to perform these services and have access to OEM parts, software updates, supplies, continuous/updated training etc. ï¿½Offers must also be accompanied by descriptive literature, delivery timeframe, warranties and/or other information that demonstrates that the offer meets all the foregoing requirements.ï¿½ Quotations will be due within fifteen calendar days from the publication date of this synopsis or by November 13, 2020 by 5:00 pm, EST. via email to ï¿½ï¿½robinsti@mail.nih.gov, ATTN: Tina Robinson, by the date and time mentioned above.
