- Page 2 of 2 Notice of Intent is published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This Notice of Intent is for a proposed award of a sole source, firm-fixed price contract under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b)(2) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. The Department of Veterans Affairs, Network Contracting Office 8, intends to award a sole source, firm-fixed price contract to Livanova USA, Inc., for Full-Service Maintenance service for Heart Lung Equipment. Equipment includes: (1) Livanova Model S5 Heart Lung Machine, S/N 48E06751, ID# 144892; (2) Livanova Model S5 Heart Lung Machine, S/N 48E06754, ID# 144893; (3) Livanova Model Xtra Autotransfusion Unit, S/N BO22896L13, ID#106642; (4) Livanova Model Xtra Autotransfusion Unit, S/N BO22877L13, ID# 106643; and Livanova Model Xtra Autotransfusion unit, S/N BO22887L13, ID# 106644. The contractor shall furnish all labor, transportation, tools, and parts necessary to provide full-service maintenance, including preventive maintenance. The North American Industry Classification System (NAICS) code for this requirement is 811219, Electronic and Precision Equipment Repair and Maintenance and the Product Service Code (PSC) is J065, Maintenance and Repair of Medical, Dental and Veterinary. The effective date of performance is on or before December 4, 2020 through December 3, 2021 and four one-year option periods. A. Services to be Provided All maintenance will be performed during normal VA business hours, 8:00 AM - 5:00 PM, Monday-Friday, except Federal Holidays, unless otherwise specified. Contractor may work outside normal business hours by arrangement with COR if such services are provided without additional charge to the government. The VA shall not provide service manuals or service diagnostic software to the contractor. The contractor shall obtain, have on file, and make available to its FSE(s) all operational and technical documentation (e.g., operational and service manuals, schematics, and parts lists) which are necessary to meet the performance requirements of this contract. The location and listing of the service data manuals, by name, and/or the manuals themselves shall be provided to the CO upon request. Any charges for parts, reagents, manuals, tools, or software required to successfully complete scheduled Preventive Maintenance (PM) are included within this contract and its agreed upon price unless specifically stated in writing otherwise. B. Parts All replacement parts required to complete scheduled preventive maintenance, except exclusions listed below, required to keep equipment performing within the manufacturer's specifications will be provided by the contractor. All parts must meet or exceed factory specifications to maintain compatibility with systems presently in place and with future performance/reliability upgrades. Parts removed (replaced) by the contractor become the property of the contractor. C. Scheduled Maintenance The contract will include one comprehensive scheduled maintenance inspections (preventive maintenance) to be performed in May and November. A mutually agreeable time for the inspections will be scheduled through the COR. Contractor does not have access to sensitive information and will not be performing service in areas containing sensitive information. Livanova USA, Inc. has provided a certified letter confirming they are the only firm who can provide this service. The Government understands that Livanova USA, Inc., is an authorized vendor for performing maintenance and repair of Livanova Heart Lung Equipment. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
