- INTENT TO SOLE SOURCE: The Birmingham VA Medical Center, VISN 7, located at 700 19th S. Birmingham AL 35233 intends to sole source to 10X Geomatics Inc, located at 7068 Koll Center Parkway Suite 401, Pleasanton CA 94566 for Chromium Next GEM Single Cell 3 Kit v3.16 rxns and Chromium Nex GEM Chip G Single Cell Kit, 48 rxns. The Research service at the Birmingham VA is proposing to purchase The Chromium Next GEM Single Cell 3 Kit v3.1 i and the Chromium Next GEM Chip Single Cell Kit which are used in tandem for RNA sequencing from single cells in order to create a library to search for genes that may be expressed differently in each cell and cell type. RNA sequencing is performed on the 10X Chromium Controller (for single cell analysis), a VA owned piece of equipment that requires reagents only manufactured by 10X Genomics is on site and to maintain consistency, this requirement is being contemplated. Description and Quantity of Supplies: ITEM INFORMATION ITEM NUMBER DESCRIPTION OF SUPPLIES/SERVICES QUANTITY UNIT 0001 1.00 KT Chromium Next GEM Single Cell 3' Kit v3.1, 16 rxns LOCAL STOCK NUMBER: 1000268 0002 1.00 KT Chromium Next GEM Chip G Single Cell Kit, 48 rxns LOCAL STOCK NUMBER: 1000120 Gray Market Prevention Language (a) Gray market items are Original Equipment Manufacturer s (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items. This notice of intent to sole source is not a request for competitive quotes; however any responsible source who believes it is capable of meeting this requirement may submit a capability statement to the contracting officer later than Monday, December 14, 2020 at 11:00 AM ET. A determination not to compete the proposed requirement based upon the responses to this notice is solely within the discretion of the Government.
