VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C24621AP1400 Contracting Activity: Department of Veterans Affairs, VISN 06, Hampton Medical Center. NCO-6 is the contracting agency and VAMC Richmond is the organizational activity responsible for the proposed contracting action. The transaction number is 652-21-2-122-0286. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Purchase and exchange of Ultrasound transducer used in the existing ultrasound system. Ultrasound transducer exchange. The ultrasound transducer produces sound waves that bounce off body tissues and make echoes. It also receives the echoes and sends them to a computer that uses them to create a picture called a sonogram. The current devices are defective beyond repair and need to be replaced Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: IAW 13.106-1 Soliciting from a single source. The requested transducers are unique to the Philips ultrasound system. These transducers were built as part of the original system and are part of the functionality of the system. No other brand of transducer will fit or are compatible with the ultrasound. A discount of 10% is being offered by Philips Healthcare, which would be a savings of approximately $6,390.00 based on the estimated quote. Description of market research conducted and results or statement why it was not conducted: Market research was conducted by the end user and two SDVOSB s responded. Further research revealed that both vendors were third party distributors. NCO 6 CO conducted a market research and two SDVOSB S showed interest, however, were found to be third party distributors. A total of 4 SDVOSB s were incapable of providing this equipment. Third party distributors cannot guarantee warranty, provide service if necessary and do not offer an equipment exchange. The VA rule of 2 or SB rule of two could not be met. The CO does not have a reasonable expectation of receiving two or more quotes from capable SDVOSB/SB firms at a fair and reasonable price. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
