- VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under $250K VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C250-21-AP-3285 Contracting Activity: NCO 10 Contracting Activity (6150 Oak Tree Blvd Independence, OH 44131). The 2237 for this procurement is 541-21-3-5751-0789 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This activity proposes to solicit with Olympus America a large business using sole source procurement procedures under NAICS Code 811219 to provide maintenance and repair of endoscopes. The endoscopes are only compatible with Olympus video equipment and processors only communicate via the CCD chip with Olympus. The equipment is specialized, and repairs should only be conducted by Olympus. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Louis Stokes Cleveland Department of Veterans Affairs Healthcare System is requesting VISN 10 Contracting Activity to enter into sole source procurement with Olympus America to complete the above stated service requirement. This request is being entered as a sole source because of the proprietary nature of the equipment. Olympus America holds proprietary rights to the scopes and these scopes must be repaired with the use of OEM parts, tools, and materials. Contractor must have direct access to OEM parts or ability to replace scope with equipment of equal value. Description of market research conducted and results or statement why it was not conducted: FAR 13.106-1-VIP queried using NAICS Code 811219 and Scopes identified no SDVOSB or VOSB contractors that are third party contractors associated with Olympus America. Proprietary parts, tools, materials, and software as applicable. - OEM Certified field service engineer. All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Third party vendors do not have access to OEM parts as it is in intellectual property of Olympus America. Therefore, the VA Rule of Two could not be met.
