- THIS IS NOT A REQUEST FOR PROPOSALS, AN INVITATION FOR BIDS, OR A REQUEST FOR QUOTATIONS. FURTHER, IT DOES NOT REPRESENT A COMMITMENT BY THE GOVERNMENT TO PAY FOR COSTS INCURRED IN PREPARATION AND SUBMISSION OF DATA OR ANY OTHER COSTS INCURRED IN RESPONSE TO THIS ANNOUNCEMENT. This is a Special Notice (PUR210095) to add the following open market item below to GSA Delivery Order 9531BM21F0050 issued to Carahsoft Technology Corporation (CARAHSOFT) under its GSA schedule contract GS-35F-0119Y for Zscaler Internet Access and Zscaler Private Access Software & Maintenance. The NTSB has a requirement for Zscaler Internet Access and Zscaler Private Access Software & Maintenance. The NTSB issued GSA eBuy RFQ1507892. The lowest priced technically acceptable offer was submitted by CARAHSOFT. The contractor�s quote contained items from its GSA schedule contract GS-35F0119Y. In addition, the contractor�s quote contained the following open market item: Manufacturer Part #: ZPA-BUSEDITION-GCH-US (OPEN MARKET)�ZPA Business Edition. Quantity: 500 This�open market item is being added to the delivery order the authority of FAR 13.106-1 and FAR 8.402(f): FAR 13.106-1(b) (1), Soliciting from a single source. Contracting Officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). In accordance with FAR 8.402(f), For administrative convenience, an ordering activity contracting officer may add items not on the Federal Supply Schedule (also referred to as open market items) to a Federal Supply Schedule delivery order only if- (1)�All applicable acquisition regulations pertaining to the purchase of the items not on the Federal Supply Schedule have been followed (e.g.,�publicizing (part� 5),competition requirements (part� 6),acquisition of commercial items (part� 12), contracting methods (parts� 13,�14, and�15), and small business programs (part� 19)); (2)�The ordering activity contracting officer has determined the price for the items not on the Federal Supply Schedule is fair and reasonable; (3)�The items are clearly labeled on the order as items not on the Federal Supply Schedule and they conform to the rules for numbering line items at subpart�4.10; and (4)�All clauses applicable to items not on the Federal Supply Schedule are included in the order. The NTSB affirms that the criteria of FAR�13.106-1(b)(1) and FAR 8.402(f) are met to add the open market item to the GSA delivery order described herein.
