Description
The ECZG Program Office intends to issue a sole source Request for Proposal (RFP) to the Boeing Company for the Space Based Space Surveillance (SBSS) Block 10 & Red Local Area Network (LAN) Sustainment Follow-On Contract 15 days after publication of this notice. SBSS Block 10 Sustainment.� The SBSS Block 10 Sustainment Follow-on contract will (1) provide sunset operations and sustainment support services to the SBSS Block 10 System, comprised of a space and ground segment and (2) decommission the SBSS system.� Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition for these highly specialized services.� These costs include: the price to purchase the SBSS Block 10 sustainment and maintenance data rights ($75M); dual personnel transition ($6.8M); obtaining software licenses ($0.3M); tailoring and integrating software for interoperability with the existing ground system infrastructure ($1.8M).� Red LAN Sustainment.� Red LAN Sustainment will provide continued operations and sustainment support services of the Red LAN which connects sensors and users for continuous flow of Space Domain Awareness (SDA) data at multiple security levels.� Award to any other source would result in 24 months of unacceptable delays in fulfilling the Government's requirement because the Government needs at least 1 year to compile the requisite data rights for competition.� Although the Government has Unlimited Data Rights to the Red LAN, the Government never acquired deliverables that will enable full and open competition because: (1) the Government did not reasonably anticipate that the Red LAN would be modified for use across the USSF SDA enterprise, and (2) the SBSS program was originally intended as a pathfinder, rather than an operational program.� �The Government shall seek to compete the Enterprise Red LAN Sustainment requirement after it has compiled all the data necessary data rights required for full and open competition.� Based on current estimates, the Government anticipates releasing the Enterprise Red LAN Sustainment solicitation by 3Q2024.� In accordance with Title 10 U.S.C. 2304(c)(1), and as implemented by FAR 6.302-1(a)(2)(iii)(A) and (B), The Boeing Company is the only responsible source that can deliver the required services. Award to any other source would result in unacceptable delays and duplication of costs; therefore, there are no viable options to obtaining competition for this procurement. While this notice of intent is for informational purposes only and is not a request for competitive proposals, interested parties, to include small and small disadvantaged businesses, may identify their interest and technical capability, and submit information which shall be considered by the agency in accordance with FAR 6.302-1(d)(2). The small business size standard for this requirement is $16.5M under NAICS Code 541990. Contractors interested in subcontracting opportunities should contact The Boeing Company directly. An Ombudsman has been appointed to address concerns from interested parties. TheOmbudsman does not diminish the authority of the program director or Contracting Officer, but communicates contractor concerns, issues, disagreements, and recommendations to the appropriate Government personnel. When requested, the Ombudsman shall maintain strict confidentiality as to the source of the concern. The Ombudsman does not participate in the evaluation of proposals or in the source selection process.
