- This is a Notice of Intent published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions and in accordance with FAR Subpart 16.505(a)(4). This Notice of Intent is for a proposed task order against an existing Indefinite-Delivery Indefinite-Quantity contract to GE Healthcare for a maintenance service contract for previously purchased GE Healthcare imaging and radiological equipment located The Audie L. Murphy VA Medical Center, 7400 Merton Minter, San Antonio, TX 78240. This is not a request for competitive quotes. Market research revealed that GE Healthcare has proprietary rights over its own equipment and is the only authorized vendor for servicing its own equipment. GE Healthcare is the only source capable of meeting this requirement and has proprietary rights to maintaining its own equipment. GE Healthcare does not have authorized resellers, dealers, or distributors to maintain its proprietary equipment. Furthermore, service by a third party would invalidate any warranties or service agreements for GE Healthcare imaging and radiological equipment previously purchased. The North American Industry Classification System (NAICS) code for this service is 334517 (Irradiation Apparatus Manufacturing) and the Product Service Code (PSC) is J065 (Maintenance and Repair of Medical, Dental, and Veterinary). While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to satisfy the requirement, including documentation from the proprietary rights holder GE Healthcare that such vendor could provide this service as an authorized dealer or third party. All responsible sources may submit a capability statement and this supporting documentation by 3:00pm Central Standard Time (CST) on 22 December 2021, which shall be considered by the agency, by e-mailing such statement and supporting documentation to Jon Parrocha, Contracting Specialist, at jon.parrocha@va.gov. Such documentation will be reviewed solely for the purpose of determining whether or not to conduct the procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government under authorities cited above.
