- 1 RENOVATE BUILDING 3 AUDIOLOGY AT MONTROSE, NY ASBESTOS AIR MONITORING and CONSTRUCTION ADMINISTRATION 620-20-205 STATEMENT OF WORK Background An area of Building 3 is being renovated to become the new Audiology Outpatient Clinic at HVHCS FDR Hospital in Montrose, NY. Some glovebag asbestos abatement will need to be performed to allow for the demolition of defunct steam pipe in the space. Additionally, some materials finished with lead-containing paint are scheduled for demolition. This will require proper planning for possible exposure assessment and area monitoring in accordance with 29 OSHA 1926.62. Objectives The first objective of this acquisition is to provide for the services of a 3rd party Certified Industrial Hygienist to perform the construction administration and air monitoring services required for the abatement of approximately 30 linear feet of ACM pipe insulation. This would involve tasks 6 through 9 of the attached document Special Instruction Asbestos and Lead Abatement. These tasks are also outlined below. The second objective of this acquisition is to provide for the services of the same 3rd party Certified Industrial Hygienist to sample lead concentrations to properly perform area monitoring in the worker breathing zone and make determinations of action level and advise on actions to be taken if/when necessary. This would involve tasks 6 through 9 of the attached document Special Instruction Asbestos and Lead Abatement. These tasks are also outlined below. Place of Performance / Place of Delivery The place of performance for this contract is VA Hudson Valley Healthcare System FDR Hospital in Montrose, NY. Period of Performance 365 Days Scope or Tasks (for services) Asbestos CIH Tasks 6-9: Task 6 Assist VA in evaluating qualifications of contractor and personnel by establishing minimum qualifications requirements for specialization experience, key personnel, standard operating procedures, etc. Task 7 Continuously monitor performance of contractor during abatement work to ensure adherence to abatement design. Monitor air quality in and around work space, worker exposure, operating procedures, respiratory protection systems, the abatement process, and the packing, transportation, and disposal of asbestos and PCB. Secure the services of a qualified analytical laboratory to turn over sample results within 24 hours unless a specific request has been made by the VA. Task 8 At the end of abatement and after final cleaning, inspect the workspace and perform the required testing to establish the decontamination level specified. Task 9 Provide a certificate to the COR certifying that the abatement process was performed in accordance with the best practice, the maximum feasible protection of people and the environment has been achieved during the abatement process, and the impacted space has achieved the VA required decontamination levels. All data, inspection results and testing results generated by the CIH will be available to the contractor for information and consideration. Monitoring and inspection results of the CIH will be used by the VA to issue any stop work or removal orders to the contractor during abatement work and to accept or reject the area or building as contaminated. The CIH will make available to the contractor the plan for sample collection and analysis for continuous monitoring outside the work area and the plan for final inspection and testing for each space or building prior to executing each plan. The plan will include the locations for samples, name and qualifications of person taking samples, the methodology of analysis and the name and address of the laboratory to be used for analysis. Provide closeout report to document all paperwork and clearances to accompany clearance certificate. Lead CIH Tasks 6-9: TASK 6: Assist VA in evaluating qualifications of contractor and personnel by establishing minimum qualification requirements for specialization experience, key personnel, standard operating procedures, etc. TASK 7: Continuously monitor performance of contractor during abatement work to ensure adherence to abatement design. Monitor air quality in and around work space, worker exposure, operating procedures, respiratory protection systems, the abatement process, and the packing, transportation, and disposal of debris following the test analysis to determine the classification of disposal. Secure the services of a qualified analytical laboratory, to turn over sample results within 24 hours. TASK 8: At the end of abatement and after final cleaning, inspect the work space and perform the required testing to establish the decontamination level specified. TASK 9: Provide a certificate to the Resident Engineer certifying that the abatement process was performed in accordance with the best practice, the maximum feasible protection of people and the environment has been achieved during the abatement process, and the impacted space has achieved the VA required decontamination levels. Review the abatement contractor close out documents, collect manifests for disposal and submit package to VA. (2- sets). Other Scope or Tasks to be included in this posting: Construction Administration services to be provided by the awardee of this contract shall include, in addition to Tasks 6-9 of the Asbestos and Lead Abatement Special Instruction, the review of submittals and enforcement of provisions included in the attached specifications for Project Number 620-20-205: Section 02 82 13 Glovebag Asbestos Abatement. Section 02 83 33.13 Lead-Based Paint Removal and Disposal These specifications as well as the project bid documents are attached to this solicitation for reference. All recommendations for actions to be taken by the general contractor shall be communicated to the asbestos subcontractor through the VA COR. Performance on this contract shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes including specific regulations related to working at the VA Medical Center at Montrose. Government-Furnished Property, Material, Equipment, or Information (GFP, GFM, GFE, or GFI) Contractor upon request will be furnished with paper copies of any available utility drawings for the areas included in the area of work. Security Contractor and subcontractor employees shall obtain day passes for any site visits from the police station. If personnel from the Contractor and subcontractor are expected to be on site more than five (5) days (cumulative), they shall file paperwork to obtain a permanent ID for the station. Necessary paperwork can be obtained from the COR. The Contractor and subcontractor employees who intend to take photos must inform the COR, at least 48 hours ahead of time, of such intentions. The C&A requirements do not apply, and a Security Accreditation package is not required. Safety Codes / Certification / Licensing Asbestos abatement work is to be performed by Contractor under supervision and monitoring for VA by a Certified Industrial Hygienist. The awardee of this contract shall act as the VA s 3rd party Certified Industrial Hygienist. The Contractor shall comply with all codes as described above, as well as codes customarily applied in VA construction jobs such as NFPA fire code, OSHA, VA Design Guides, etc. Labs used by the contractor shall be licensed as required by any applicable governing agencies, and their certifications and licenses shall be included in the reports. Travel Contractor and/ or subcontractor(s) will travel from their place of business to Montrose campus of HVHCS. Special Material Requirements No special materials are anticipated for this contract. Any Other Requirements unique to the solicitation. None. NARA Records Management Requirements. The following standard Items relate to records generated in executing this contract: Citations to pertinent laws, codes and regulations such as 44 U.S.C Chapter 21, 29, 31and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract. The Government Agency owns the rights to all data/records produced as part of this contract. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.]. VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors Contractor employees who work in or travel to VHA locations must comply with the following: Documentation requirements: If fully vaccinated, shall show proof of vaccination. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination. If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor s order or an FDA approved over-the-counter test. Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel. Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.
