- THIS IS A�NON-COMPETITIVE NOTICE OF INTENT TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION, NOT A SOLICITATION FOR COMPETITIVE PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Center for Advancing Translational Sciences (NCATS) part of the National Institutes of Health (NIH), intends to negotiate on a sole source basis with PerkinElmer Health Sciences Inc., 710 Bridgeport Avenue Shelton, CT 06484-4794, to provide 384-well black, tissue culture treated, dual barcoded plates that limit the availability to a sole source are that these plates are continuously being used in ongoing screening assays on various robotic systems as well as offline; they are well validated. � The acquisition of these plates will allow scientists to support ongoing work for small molecule and combination screening, in silico virtual screening, nanobody/antibody design and optimization that are part of NCATS�s ongoing work to support the pandemic response. In addition, we are performing in vitro assays to support ACTIV Trace�s efforts to characterize the response of variant SARS-CoV2 viruses to current vaccine and therapeutic interventions.� REASON FOR NON-COMPETITIVE ACTION The essential characteristics of the 384-well black, tissue culture treated, dual barcoded plates that limit the availability to a sole source are that these plates are continuously being used in ongoing screening assays on various robotic systems as well as offline; they are well validated. Only this suggested source can furnish the requirements, to the exclusion of other sources, because these particular microtiter plates are compatible with our robotic systems and have been validated for several assays across multiple groups and projects.� Changing this would interrupt productivity making the re-validation of a different plate necessary which will be time consuming and cause discontinuity within the numerous ongoing projects already using the Perkin Elmer plates. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures, and the procedures prescribed in FAR Subpart 13.106-1(b)(1), Soliciting from a single source. The resultant contract will include all applicable provisions and clauses of the FAR in effect through the Federal Acquisition Circular (FAC) 2022-04, dated January 30, 2022. HHS reserves the right to exercise priorities and allocations authority with respect to this contract, to include rating this order in accordance with 45 CFR Part 101, Subpart A�Health Resources Priorities and Allocations System. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B.
