DEPARTMENT OF VETERANS AFFAIRS SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5 Acquisition Plan Action ID: 36C248-22-AP-4097 Contracting Activity: Department of Veterans Affairs (VA), Network Contracting Office 8 (NCO 8), Orlando Contracting Services Team, 13800 Veterans Way, Lakemont Building, Orlando, Florida 32827-7403 is processing Purchase Request (PR) #: 675-22-3-6540-0990 submitted by the Facilities Management Services (FMS), Orlando Veterans Affairs Healthcare System (OVAHCS) located in Orlando, Florida. Nature and/or Description of the Action Being Processed: The OVAHCS requires EMERGENCY electrical repairs (parts & labor) to restore power at the Lake Baldwin VA Medical Center (VAMC). This new contract action will be awarded as a one-time, firm fixed-priced contract. Description of Supplies/Services Required to Meet the Agency s Needs: The Lake Baldwin VAMC has suffered catastrophic power failure which has destroyed the both underground (north & south) main electrical feeds supplying power to the entire VA campus. The FMS department requires an experienced medium & high voltage power contractor assess, troubleshoot & diagnose, and provide immediate repairs to restore power to the VA campus. Work will include excavation to access & replace underground power lines feeds, new splices, a temporary fix to bypass (2) blown PSE5 switches until replacement switches are ordered/received (currently 28-week lead-time from the factory), as well as ancillary parts for medium to high voltage electrical systems, specialized labor (medium/high voltage electricians), and load testing to ensure power can be safely maintained upon restoration. The estimated value is $396,703.13. The estimated work time to make repairs is 4 days, a 28-week lead time to obtain replacement switches and 3-days to replace/load test switches once received. Statutory Authority Permitting Restricted Competition:  FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement.  Competition is restricted on this procurement for the reason below:         (X)  Unusual and Compelling Urgency Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Due to an unknown catastrophic event, the Lake Baldwin VAMC lost the power feed from the city s power grid system and has resorted to the distribution of auxiliary power using the onsite emergency generator system. The Lake Baldwin VAMC power system infrastructure is essential equipment and requires immediate repairs to preclude impairment of healthcare delivery capabilies and mission performance. Without the immediate restoration of power, the Lake Baldwin VAMC cannot provide medical services for (already) scheduled appointments; and consequently, would result in hundreds of unplanned referrals & authorizations for Veterans to receive care from community provider and negatively impact financial budgets for care. Dancy Contracting, LLC (Dancy) is a verified Service-Disabled, Veteran-Owned Small Business (SDVOSB) and certified electrical contractor and general contractor with experience in all aspects of electrical work. Dancy was contacted and able to provide direct response by dispatching a medium/high voltage repair crew (engineer, master electricians, journeymen, & helpers) capable of immediate assessment, troubleshooting, and repair services onsite within an hour. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: In accordance with FAR 5.202 Exceptions, the Contracting Officer need not submit the notice required by 5.201 when the proposed contract action is made under unusual & compelling urgency. In this case, the immediate need for repair and restore power to the Lake Baldwin VAMC precludes competition to the maximum extent possible. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer shall use techniques and procedures set forth in FAR 13.106-3 to establish price reasonableness and ensure the contract price will be fair & reasonable. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was limited to an examination of the acquisition history and experience within the marketplace under previous acquisitions for similar medium & high voltage repairs due to the urgency of this requirement. A search of the Veterans Information Pages (VIP) website was performed to satisfy the Rule of Two compliance with PPM 2016-05, Implementation of the Veterans First Contracting Program. A search using NAICS 238210 Electrical Contractors servicing Florida identified 112 possible SDVOSBs & VOSBs. A review of the results identified (3) known SDVOSBs that have provided medium & high voltage electrical repairs in the past. The list included: Venergy, Eau Galle Electric, and Dancey Contracting. Of the three local firms, Venergy is located in Fort Pierce FL more than 120 miles away; Eau Galle Electric is located in Melbourne FL more than 71 miles away; and Dancey Contracting is located in St. Cloud FL at 28 miles away. The decision to contact Dancey Contracting, a verified SDVOSB, was made due to their close proximity and shortest mobilization/response-time. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Dancey Contracting 2455 Underwood Ave., St. Cloud, FL 34771. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This action will only address the needed repairs to restore power and repair the current power infrastructure back to fully operational. Any desire to upgrade or modify/improve the power infrastructure will be identified and solicited through separate competitive action(s).
