Description
NOTICE OF INTENT TO NEGOTIATE A SINGLE-SOURCE CONTRACTSpecial Notice:FD-2022-334 NOAA/NMFS/SEFSC In compliance with FAR Subpart 13 coupled with the provisions set forth by FAR Subpart 5.101(a)(1), this Notice is hereby published to inform of the following: The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Office of Management and Budget (OMB) intends to negotiate, on a sole source basis, under the authority of FAR 13.106-1(b)(1), with Horiba Instruments Incorporated Using the procedures of FAR Part 13 the requirement is to procure the following: The requirement is for the purchase of a HORIBA Raman Basic Plus maintenance contract which includes application support, phone/remote support, on-site visits, preventive maintenance and emergency visits (which include labor costs and travel costs incurred during the visit), discount on replacement parts, discount on consumable parts, discount on excluded parts purchased from HORIBA Instruments for a HORIBA LabRAM Soleil confocal Raman microscope.The applicable Size Standard is North American Industry Classification System (NAICS) Code811219with a Small business size standard of$22.0M A HORIBA LabRAM Soleil confocal Raman microscope (S/N: 1014) was procured in 2020. This instrument requires a service maintenance contract to ensure the government is able to maintain this highly specialized instrument so that performance is optimal and to ensure performance does not deteriorate or fail. Market research shows that HORIBA Instruments Incorporated is the only vendor that can provide maintenance, repair, upgrade parts, software, and spare parts for the Raman LabRAM Soleil confocal Raman microscope. All warranties and/or service contract coverage will be void if another vendor provides services to hardware or software for the instruments. The base period of performance for the HORIBA Raman Basic Plus maintenance contract is effective from the date of award through 12 months post-award with four option years. **THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS AND NO SOLICITATION PACKAGE IS AVAILABLE. HOWEVER, FIRMS THAT BELIEVE THEY CAN FULLY MEET THE GOVERNMENT'S REQUIREMENTS MAY SUBMIT SUBSTANTIATING DOCUMENTATION IN WRITING TO THE IDENTIFIED POINT OF CONTACT WITHIN 15 DAYS AFTER PUBLICATION OF THIS SYNOPSIS. SUCH DOCUMENTATION WILL BE EVALUATED SOLELY FOR THE PURPOSE OF DETERMINING WHETHER OR NOT TO CONDUCT THIS PROCUREMENT ON A COMPETITIVE BASIS. A DETERMINATION BY THE GOVERNMENT NOT TO CONDUCT A COMPETITIVE PROCUREMENT, BASED UPON RESPONSES TO THIS NOTICE, IS SOLELY WITHIN THE DISCRETION OF THE GOVERNMENT.
