- THIS IS NOT A REQUEST FOR QUOTE - THIS IS A NOTICE OF THE GOVERNMENT'S INTENT TO ISSUE A SOLE SOURCE AWARD: The United States Department of Agriculture (USDA) Animal Health Inspection Service (APHIS) Grain Inspection, Packers & Stockyards Administration Technology and Science Division (GIPSA TSD) intends to issue a noncompetitive�contract to BioMerieux, Inc. located in Kansas City, MO for servicing equipment manufactured by BioMerieux, Inc. Equipment includes a Tempo Reader and Tempo Filter, associated software, installed components and connected equipment. See attached statement of work and justification for other than full and open competition. This purchase will be under the statutory authority permitting Other than Full and Open Competition� 41 U.S.C. 253( c )(1) FAR 6.302-1 which states; The property or services needed are available from only one responsible qualified source at this time and no other type of property or services will satisfy these needs. TSD provides analyte testing of grain and grain-related commodities for facilitation of the U.S. grain market.� To continue support of existing programs and meet the growing need for comprehensive coverage in food contaminant analyses, FGIS, TSD needs to purchase maintenance coverage for BioMerieux Tempo reader and Tempo Filler instrumentation, associated software, and installed components, and connected equipment.� The system, and all of the associated components, are used for evaluating the safety/health risks of U.S. grain related to microbiological contamination in support of the United State Agency for International Development. The maintenance will provide replacement or repair to any defective parts of the BioMerieux Labatory equipment located at the AMS FGIS TSD lab. The maintenance agreement shall cover the cost of onsite repair service, including emergency repair, parts, labor, travel, and telephone support for troubleshooting, for a 4 year period. BioMerieux, Inc is the only manufacturer of the proprietary BioMerieux Labatory equipment. This product makes use of patented technology to deliver a uniform and consistent dose satisfying the exacting needs of researchers. Due to the highly specialized nature of the equipment, BioMerieux, Inc technicians are the only technicians who are qualified to repair the equipment. The USDA intends to issue a four year commercial firm-fixed price contract for these services.� This notice of intent is NOT a request for proposals or competitive quotations. Request for copies of a solicitation in response to this notice will not be honored or acknowledged. A determination not to compete this proposed action is solely within the discretion of the Government. However, if a firm believes it can meet the requirements it must furnish information about its products, pricing, and specifications, as well as three (3) references for other customers who are using these products� to the Contracting Specialist by 10:00 am Mountain Time (MT) on or before the closing date of this notice. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirement. All information submitted should support the capability to provide the items required and shall be furnished at no cost or obligation to the Government. The Government reserves the right to cancel the Sole Source Award.
