- In accordance with Federal Acquisition Regulation 13.106-1(b)(1) (SAP)(Brand-Name), the US Environmental Protection Agency intends to award a sole source fixed price Purchase Order. The US Environmental Protection Agency (EPA) Information Technology Acquisition Division (ITAD), on behalf of the Office of Research and Development, Center for Environmental Solutions and Emergency Response (CESER), Water Infrastructure Division (WID), Chemical Methods and Treatment Branch (CMTB), BOC 36, has a requirement to add one user for Waters Corporation�s Progenesis QI, Part Number 176003435. This is a one-time purchase for a permanent license that will not need to be renewed in the future. This requirement adds a second user license for an existing software, which is needed to access the software remotely while teleworking and to allow for multiple users onsite as well. Progenesis QI is a metabolomics program used to analyze high resolution mass spectrometry data. The software is developed by Nonlinear Dynamics and sold and distributed by Waters Corporation. This second software license is an addition to an already purchased and installed software, which is only available through Waters Corporation and cannot be purchased from any other vender. Waters is the sole manufacturer of this software, which is needed to analyze data from Waters mass spectrometers. Waters service engineers are certified Waters factory trained engineers and possess proprietary knowledge and skill pertaining to the Progenesis software and their mass spectrometry systems. Software upgrades, protocol compliance, and remote monitoring and diagnostic services are proprietary to Waters. Due to the proprietary nature of the Progenesis QI software system, termination of current and future service agreements will occur if any modification, adjustment, relocation or repair is not furnished by Waters trained and certified service engineer thus adversely affecting system performance. (see Waters� Service Plans Terms and Conditions). For these reasons, additional licenses, and maintenance for and repair of the systems cannot be alternatively sourced. The ORD/CESER/WID/CMTB lab is a high performing analytical lab. It is essential that the Progenesis QI software system needed to analyze data from the Waters mass spectrometers remains fully operational and accessible for multiple users in remote locations at all times in order to prevent the disruption of scientific research and potential loss of scientific research data. THIS IS NOT A SOLICITATION FOR REQUEST FOR QUOTE (RFQ) DO NOT SUBMIT A QUOTE This announcement constitutes the only synopsis for this requirement; and is issued for notification purposes only. No known potential alternate sources exist which could satisfy this requirement. This notice of intent is not a request for quote/proposal. Any interested party that believes it can meet this requirement described herein may identify themselves and must provide evidence of their capability to fulfill this requirement being requested by 12 PM (noon) EST on September 13, 2022. Telephone responses and requests will not be accepted. A determination by the Government not to compete this requirement based on responses to this notice is solely within discretion of the Government. Information received will be considered solely for the purposes of determining whether to conduct competitive procurement. The North American Industrial Classification System (NAICS) code for this effort is 334516 and the business size standard is 1,000 EMPLOYEES. All current and potential contractors shall use FedConnect which is available at https://www.fedconnect.net/FedConnect/default.htm. There is no charge to use FedConnect. FedConnect is hosted by Compusearch, all related questions from vendors/contractors will be answered by Compusearch. If having issues with FedConnect or not registered in FedConnect at this time an exception is extended and alternate responses may be received by email: cannon.stephen@epa.gov. NOTE: If your firm is an authorized software distributor or equipment service/software license maintenance management provider; provide documentation confirming authorization and certified capability from the manufacturer to perform service/maintenance/repair to add the Progenesis QI additional software license component identified in this notice. Responses to this notice without this confirmation from the manufacturer will not be considered as valid.
