36C246-22-AP-2301 Page 1 of 9 Effective Date 02/01/2022 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Justification for other than full and open competition."" 6.303-2(b)(1) Acquisition Plan Action ID: 36C246-22-AP-2301 Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 6 proposes to enter into a contract on the basis of other than full and open competition for the Hampton VA Medical Center (VAMC). Purchase Request 2237 # 590-22-2-985-0086. Nature and/or Description of the Action Being Approved: Network Contracting Office (NCO) 6 intends to award a new, firm fixed price sole source contract to Accessibility Services, Inc. a Small Business, for the autonoME System at the Hampton VA Medical Center (VAMC). This requirement is for purchase and installation of autonoME PECU System in the SCI Area. Description of Supplies/Services Required to Meet the Agency s Needs: The Hampton VA Medical Center requires the equipment and installation of a turn-key advanced environment control system for the SCI area to assist veterans. This system supplements nursing care for patients with spinal cord injuries and similar disorders and provides them with a new level of independence. The contractor will provide a complete, turn-key system to include nurse call, bed control, lights, telephone and television, medical grade 22 monitor, Windows 10 OS and proprietary autoME software with 2 year security certificate; articulating wall mounted arm; autonoME Command Center; autonoME JCT box for the bed control with installation, training for super users, technical staff and nursing staff. The total estimated cost is $828,300.00 and the required installation date is one hundred eighty days from date of award. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-1 . ( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1 Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Accessibility Services, Inc. (ASI) is the sole OEM for autonoME and the sole provider of the system. ASI has provided innovative solutions to meet patient needs for 30+ years to the VA. The autonoME PECU System has been installed in VAMC Hampton, Hunter Holmes Veterans Medical Center and the Memphis Innovation Center. The system has proven itself to provide invaluable service for both veterans and staff. The Contracting Officer estimates that an award can be made at a fair and reasonable price. Government. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted, details of which are in section 8 of this document. This effort did not yield any additional sources that can meet the Government s requirements. ASI was identified as the only OEM and the sole provider of the system. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer will determine the proposed price to be fair and reasonable based on a comparison of the cost of the system installed in the past and amount of reduced staff time investment in such tasks as bed adjustments, telephone use, light adjustments, television adjustments, and overall patient satisfaction with access to games, zoom, kindle books, videos, and netflix. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted to identify available sources and to evaluate the availability of the marketplace to meet the requirement. Extensive market research including direct contact with multiple healthcare facilities, internet searches and equipment providers revealed no other sources for systems of this type on the market. Any Other Facts Supporting the Use of Other than Full and Open Competition: No additional facts are available at this time. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable competition for future actions.
