- This is a Special Notice to all Department of Health and Human Services (HHS) Service Contractors.� This is to alert you that the deadline for Fiscal Year (FY) 2022 Service Contract Reporting Requirements is approaching.� In accordance with Federal Acquisition Regulation, failure to complete Service Contract Reporting in the System for Award Management (SAM) by January 31, 2023, will result in your noncompliance being included in your contractor performance evaluation in the Contractor Performance Assessment Reporting System (CPARS).� Please note, CPARS is used to inform source selections across government.� Therefore, HHS urges its contractors to complete the reporting requirement before the January 31, 2023 due date. � Subject:� Notice to all Department of Health and Human Services (HHS) Service Contractors -�January 31, 2023�Deadline for FY 2022 Service Contract Reporting Requirements When is Service Contract Reporting required? The System for Award Management (SAM) opened for FY 2022 Service Contract Reporting on October 6, 2022. Contractors are reminded to complete data entry by December 15, 2022. Although the reporting period ends January 31, 2023, data reported after December 15, 2022 will be considered late. What is Service Contract Reporting? The Service Contract Reporting (SCR) requirements under Section 743 of Division C, of the Consolidated Appropriations Act, 2010 (Pub. L. 111-117), requires civilian agencies to prepare, submit and make publicly available, an annual inventory of activities performed by service contractors. The final Federal Acquisition Regulation (FAR) rule became effective to implement statutory requirements for service contract supplemental reporting on January 30, 2014. In accordance with FAR 4.1702, contractors and first-tier contractors are required to report in the System for Award Management (SAM) for the previous fiscal year the (1) total dollar amount invoiced for services performed and (2) direct labor hours expended on the services performed under certain contracts. Service Contract Reporting applies to all contracts for services (including construction) that contain FAR clause 52.204-14, Service Contract Reporting Requirements and/or FAR clause 52.204-15, Service Contract Reporting Requirements for Indefinite-Delivery Contracts.� � � � � � � � � � � �� Which awards require Service Contract Reporting? In accordance with FAR 4.1703, service contractor reporting is required for contracts and first-tier subcontracts for services based on contract type and estimated total value. For indefinite-delivery contracts, reporting shall be determined based on the type and estimated total value of each order under the contract. Indefinite-delivery contracts include, but are not limited to, contracts such as indefinite-delivery indefinite-quantity (IDIQ) contracts, Federal Supply Schedule contracts (FSSs), Government wide acquisition contracts (GWACs), and multi-agency contracts. What are the reporting thresholds? In accordance with FAR 4.1703 (a)(2), reporting is required according to the following thresholds: All cost-reimbursement, time-and-materials, and labor-hour service contracts and orders with an estimated total value above the simplified acquisition threshold. �All fixed-price service contracts awarded and orders issued according to the following thresholds: Awarded or issued in Fiscal Year 2014, with an estimated total value of $2.5 million or greater. Awarded or issued in Fiscal Year 2015, with an estimated total value of $1 million or greater. Awarded or issued in Fiscal Year 2016, and subsequent years, with an estimated total value of $500,000 or greater. Reporting is required for all first-tier subcontracts for services as prescribed by FAR 4.1703 (a)(2)(i) and (ii). Please contact your Contracting Officer immediately with any questions or requests for reporting requirement clarifications.
